Comments:
An unannounced monitoring inspection was conducted on 07/25/2023 from 9:55 am to 3:45pm with director and another licensing inspector. There were 149 children ages five years to 12 years old supervised by 20 staff. The physical plant, outdoor playground area, programming, attendance, five staff records, eight children?s records, 12 medications with corresponding authorization records, emergency drills, and policies were reviewed. Children were observed participating in art activities, reading and outside group play. Areas of non-compliance are identified in the Violation Notice.

Violations:
Standard #: 8VAC20-780-160-A
Description: Based on a review of five staff files, the center did not obtain documentation of a tuberculosis (TB) screening for staff at the time of employment and prior to coming in contact with children

Evidence: The record for Staff #4, with a start date of 7/1/21, did not contain documentation of a tuberculosis screening at the time of inspection

Plan of Correction: Ensure staff TB paperwork is current and updated. TB paperwork placed in file.

Standard #: 8VAC20-780-330-B
Description: Repeat Violation

Based on observation and measurement, the center did not ensure that resilient surfacing complies with the minimum safety standard where playground equipment is provided.

Evidence: There was less than one inch of mulch observed at the base of the composite play structure and four swings. The mulch has deteriorated into dirt and grass is growing throughout the fall zones. Six inches of resilient surfacing is required based on the height of the play equipment and the type of resilient surfacing.

Plan of Correction: Children were not permitted on the playground on 7/25/2023. Children will not be permitted on the playground until the resilient surface is in compliance.

Standard #: 8VAC20-780-400-B
Description: Based on observation and interview, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate.

Evidence: At approximately 10:30am on 7/25/23, Licensing Inspectors (LIs) observed Child #6, 12-years-old, sitting outside at a picnic table alone with no activity while the kindergarten group of five and six-year-olds played nearby. Interview with director revealed that Child #6 was bothering their sibling in the other class so Child #6 was moved from their age group to the kindergarten group at 8 am.

Plan of Correction: Staff will follow discipline policy. Children will receive documentation for misbehaviors, parents will be called and/or children will be picked up due to misbehaviors.

Standard #: 8VAC20-780-520-B
Description: Repeat Violation

Based on observation and interview, the center did not meet all the requirements for sunscreen application.

Evidence:
1. Staff stated that liquid sunscreen is applied by the children in all classrooms and spray sunscreen is applied by the teacher. The standard requires staff apply all sunscreen to children eight-years -old and under.
2. There was no written documentation from parents of any adverse reactions to sunscreen as required in the standards.
3. In the first grade group, nine containers of sunscreen did not contain a label with a child?s name. When asked, staff could not identify the owner of the unlabeled sunscreen.

Plan of Correction: Staff will assist with applying sunblock on children under the age of eight.

Parents will complete an over the counter form to include any adverse reactions.

Staff will do a weekly sunblock label check to ensure first and last names are on all sunblock.
