Comments:
An monitoring inspection was conducted on 08/22/2023 and 09/ 06/2023 in result of a report to VDOE of a Injury of a Child Requiring Outside Medical Treatment or Death report. The investigation was conducted jointly with local agency. Staff were interviewed, documentaiton reviewed and area of observation was conducted.

Areas of non-compliance are identified on the violation notice.

Violations:
Standard #: 8VAC20-780-80-B-2
Description: Based on record review and interview, the center did not ensure to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.

Evidence:
The center contacted the Licensing inspector on August 4, 2023 for an incident that happened on July 31, 2023. The center was made aware on August 1, 2023, that outside medical attention had to be obtained for child #1 who was diagnosed with a mild concussion.

The injury report was signed on August 1, 2023.

Plan of Correction: Investigation concluded on August 2nd and reported August 4th .
The center will report the outside medical treatment with in 2 buisness days
to allow licensing office to initate the investigation.

Standard #: 8VAC20-780-340-A
Description: Based on interviews and documentation, the licensee did not ensure care protection and guidance.

1. On July 31, 2023, it was determined that Child #1 sustained an injury at the center that required outside medical attention. The child was found sleeping when it was time for him to be picked up from the center and he was later diagnosed with a concussion.

2. While on the outdoor pavilion, Staff #1 reported that she noticed Child #1 crying. Child #1 was allegedly pushed or hit by another child in care. The incident occurred near the end of the work shift for Staff #1 who was about to leave for the day.

3. The center?s incident report documentation states that Staff #1 saw that Child #1 was pushed into a wooden column on the center?s pavilion. The documentation also states that Staff #1 left the center and did not make other staff aware that Child #1 hit his head.

Plan of Correction: Going forward staff will be reminded the safety of all children is paramount and it
comes before staff 's needs. Staff will also be reminded that all reporting must be
accurate, immediate and truthful regardless of who or what it involves.
Staff was released the next day after the incident.
