22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A follow-up monitoring inspection was conducted on November 17, 2023. The inspectors were on site from approximately 2:00 pm until 2:30 pm. The director was on site and assisted with information obtained.

The inspector reviewed compliance in administration. Records were reviewed for two board officers and the individual identified on the renewal application whose name is to be listed on the public website. On December 14, 2023, additional documentation regarding background checks was received by the Department. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

The inspection report was amended on 12/29/2023.

Violations:
Standard #: 22.1-289-036-C
Description: Based on review of documentation received by the Department on December 14, 2023, an applicant for licensure has been convicted of at least one barrier crime as defined in ? 19.2-392.02 and has not been granted a waiver to receive a license to operate a child day center within the Commonwealth of Virginia.

Evidence:

1. Disqualifying documentation of a national criminal background check was received by the Department on December 14, 2023 for Applicant #1. The determination letter was dated December 13, 2023 and stated that Applicant #1 was ?Not Eligible?.
2. The most recent renewal application for licensure identified Applicant #1 as the person to be listed on the public website for the child day center. The renewal application was signed by Agent #1 on August 7, 2023.
3. Agent #1 reported on November 17, 2023 that Applicant #1 is the owner of Y-Me Child Care Center and his responsibilities include payroll for staff and maintenance of the building and the vehicles used to transport children in care.
4. Agent #1 reported that Applicant #1 has remained involved in the day-to day operations of the center since the occurrence in 2017.

Plan of Correction: Depending on the Department of Education decision, transfer of ownership will begin 01/02/24 or effective immediately.
1. The previous owner was not aware that a waiver was needed to continue ownership of a childcare business. Research on how to be granted a waiver will be done.
Therefore, Ownership of the child care center will be transfer to the previous owner'S' Wife or Center Director.
3.Center Director reported that the owner is not involved with the children during child care hours since the occurrence in 2017. Therefore, to understanding, background check renewals on the previous owner was not needed. During all the years of inspection, Licensing never asked for the owner's information. Only staff files.

Description: REPEAT
Based on review of documentation and interview, the center failed to obtain a sworn statement, central registry check and national criminal history record check every five years from the date of the original background check for Applicant #1.

Evidence:

1. The record of Applicant #1 contained documentation of a sworn statement dated 11/15/2014, central registry search dated 11/05/2014, and a criminal history record check dated 12/05/2014.
2. The most recent renewal application for licensure identified Applicant #1 as the person to be listed on the public website for the child day center. The renewal application was signed by Agent #1 on August 7, 2023.
3. Agent #1 reported on November 17, 2023 that Applicant #1 is the owner of Y-Me Child Care Center and his responsibilities include payroll for staff and maintenance of the center and the vehicles used to transport children in care.
4. Agent #1 reported that Applicant #1 has remained involved in the day-to day operations of the center since the occurrence in 2017.

Plan of Correction: 1. The center director is and will be responsible for obtaining updated background checks on all staff members every five years.
2. The Center Director has signed the renewal application and will be listed on the website as the contact person.
3. The Center Director will be responsible for staff payroll and the van and office equipment maintenance. The owner of the building will be responsible for the up-keep of the building maintenance/repairs reported by the Center Director.
