Technical Assistance:
The Vendor must send evidence to the licensing inspector that the background checks have been requested no later than 10 days of this notification dated 10/26/2023. The applicant must also then forward the results to the licensing inspector upon receipt.

Comments:
A subsidy health and safety (SHSI) inspection was completed on 10/13/2023. A Voluntary Registered Monitoring Inspection was also conducted on this date. The inspections began at 1:20 pm and concluded at 4:14 pm. The sample size consisted of 4 children?s records and 1 provider record. Records were not present for 2 children in care and one adult household member. Children were observed sleeping at nap time, having an afternoon snack, and engaged in free play. The vendor states that she does not administer medication to children in care. Hand washing and restroom procedures were observed, Information gathered during the inspection determined violations with applicable standards or law. Violations are identified on the violation notice.

Violations:
Standard #: 8VAC20-790-170-C
Description: Based on record review and interview, the vendor did not ensure that every adult household member undergoes a background check in accordance with ? 22.1-289.040 of the Code of Virginia.

Evidence:
The vendor identified a male adult who left the premises following the arrival of the inspector as an adult household member who she said had been residing in her home for approximately 3 months (household member #2).

The vendor stated that she had not obtained a signed Sworn Disclosure or Affirmation for household member #2.

The vendor stated that she did not have the results of a Criminal History Search and had not yet requested a Criminal Record Search for household member #2.

The vendor stated that she did not have the results of a Search of the Central Registry and had not yet requested Search of the Central Registry for household member #2.

Plan of Correction: The vendor will have household member #2 complete a sworn affirmation or disclosure statement this week.

The vendor will submit a request for a search of the central registry for household member #2 by no later than 10 days following receipt of this inspection report on 10/26/2023.

The vendor have household member make an appointment to have fingerprints taken for a Criminal Records Search no later than 10 days following receipt of this inspection report on 10/26/2023.

Documentation verifying that the request for Search of the Central Registry was submitted with payment and an appointment confirmation for scheduled fingerprinting will be sent to the licensing inspector within 10 days of this notice dated 10/26/2023.

Standard #: 8VAC20-790-170-D
Description: Based on observation and interview, the vendor did not always ensure that the family day home did not exceed the capacity of children cared for as allowed by law or regulation.
Evidence:
This vendor operates a voluntary registered Home which allows for no more than 4 non-household children in care at any one time.

The inspector observed a total of 6 children downstairs upon arrival to the home at 1:20 pm.

The vendor identified these 6 children as 4 enrolled children in care (child #1, child #2, Child #3 and Child #4) as well as one family member?s child (child #5) who is not normally in care and one household child (child #6) at the time of arrival.

At approximately 1:45, the inspector asked to view second floor of the home. A child was sitting in the stairwell as the vendor climbed the stairs ahead of the inspector.
The vendor stated that this child (child #7) was a family member?s child who had been sleeping upstairs because he was sick.

The total number of non-household children present in the home was 6.
One adult, who was identified by the provider as a household member, left the home following the inspector?s arrival.
There were no other adults present in the household during the inspection.

Plan of Correction: The vendor will limit the number of non-household children to a maximum of four, at any given time, in accordance with law / regulation of Voluntary Registered day homes.

Standard #: 8VAC20-790-180-B
Description: Based on observation and interview the vendor shall maintain a written hard copy record of daily attendance that documents the arrival and departure of each child in care as it occurs.

The vendor was asked to provide the written attendance for review during the inspection. The vendor stated that she did not keep a written attendance record.

Plan of Correction: The vendor will maintain a written hard copy record of daily attendance that documents the arrival and departure of each child in care as it occurs

Standard #: 8VAC20-790-190-B
Description: Based on a review of documentation and interview, the vendor did not maintain a record for each child containing all of the required information.
Evidence:
The vendor was asked to provide the records for the 6 non-household children present during the inspection.
6 of 6 non-household children in care (#1, #2, #3, #4, #5, #6) did not have the following information or documentation available for review:
Child's full name, nickname (if any), sex, address, and birthdate;
Proof of the child's identity;
Name, home address, and telephone number for each parent who has custody;
Name, address, and telephone number for each custodial parent's place of employment or school attendance, if applicable;
Name, address, and telephone number of at least one person designated by the parent to contact in case of an emergency if the parent cannot be reached ;
If applicable, information on allergies, including food allergies, intolerances to food, medication, or other substances, and actions to be taken in an emergency situation; information on other physical problems; pertinent developmental information; and any special accommodations needed;
Names of persons other than the custodial parent who are authorized to pick up the child;
Written authorization for emergency medical care should an emergency occur and the parent cannot be located immediately unless the parent presents a written objection for the provision of medical treatment on religious or other grounds;
Written authorization to administer prescription or nonprescription medications if the vendor agrees to administer medication;
Special care instructions, including recommendations for the care and activities of a child with special needs, exception to infant being fed on demand, etc.;
A written care plan for each child with a diagnosed food allergy, to include instructions from a physician regarding the food to which the child is allergic and the steps to be taken in the event of a suspected or confirmed allergic reaction;
Record of any accidents or injuries sustained by the child while in care;
Permission to transport child if the vendor provides transportation;
Permission for field trips;
Permission for swimming or wading activities to include a parent's statement of the child's swimming ability, if applicable;
A written statement that the vendor will notify the parent when the child becomes ill and that the parent will arrange to have the child picked up as soon as possible if so requested by the vendor;
Any written agreements between the parent and the vendor.
The vendor confirmed that a record containing the aforementioned information was not available for child #1, child #2, child #3, child #4, child #5 or child #6, who were present during the inspection.

Plan of Correction: The vendor will require parents of enrolled children to complete paperwork and submit documentation of all required information for each child and the children's records will be maintained securely in the home.

Standard #: 8VAC20-790-230-A
Description: Based on a review of documentation and interview, the vendor did not always obtain documentation that the child has been immunized according to the requirements of subsection A of ? 32.1-46 of the Code of Virginia and applicable State Board of Health regulations for each child before they attend the family day home.
Evidence:
The vendor was asked to provide the immunization records for the 6 non-household children present during the inspection.
The vendor stated that an immunization record was not available for two of the 6 non household children in care (child #5 and child #6).

Plan of Correction: The vendor will obtain documentation that the child has been immunized according to the requirements of subsection A of ? 32.1-46 of the Code of Virginia and applicable State Board of Health regulations for each child before they attend the family day home.

Standard #: 8VAC20-790-260-C-2
Description: Based on observation and interview, the vendor did not always ensure that electrical outlets are capped with protective covers that are of a size that cannot be swallowed by children.
Evidence:
There were 3 uncapped outlets in the living room, 2 uncapped outlets in the kitchen, and 3 uncapped outlets in the area where the kitchen table was located. These outlets were accessible to the children in care and located in areas that are part of an open floor plan where children were present during the inspection. The vendor acknowledged that these outlets were not capped.

Plan of Correction: The vendor placed outlet covers on the accessible, uncapped outlets during the inspection. The vendor will ensure that outlets accessible to children in care are always fitted with an outlet cover when children are in care.

Standard #: 8VAC20-790-300-A
Description: Based on observation and interview, the vendor did not ensure that a caregiver provides direct care and supervision of each child at all times. To include an awareness of and responsibility for each child in care, including being near enough to intervene if needed.
Evidence:
The inspector arrived at the home at 1:20 pm. At approximately 1:45, the inspector asked to view second floor of the home. A child was observed sitting alone near the top of the stairwell. The vendor stated that this child (child #7) was a family member?s child who had been sleeping upstairs because he was sick and had been in the care of the other adult, who left the home following the inspector?s arrival. The vendor stated that child #7 was 5 years old.

Plan of Correction: The vendor will ensure that she is able to provide direct care and supervision of each child at all times which will include awareness of each child in care and close proximity so that she may intervene or assist children, as needed.

Standard #: 8VAC20-790-430-A-1
Description: Based on documentation review and interview the vendor was unable to demonstrate that Evacuation procedures are practiced at least monthly.
Evidence:
The vendor was unable to provide documentation of any emergency drills being practiced with children in care.
The vendor stated that she did not have any documentation of drills practiced because she had not practiced emergency drills with the children in care.

Plan of Correction: The vendor will practice Evacuation procedures at least monthly and will use the log provided to her to document these drills.
