22.1 EARLY CHILDHOOD CARE AND EDUCATION

Comments:
A follow-up monitoring inspection was conducted today, January 17, 2024. The inspectors were on site from approximately 1:45 pm until 2:20 pm. The director was on site and assisted with information obtained. The inspector reviewed compliance in administration. Records were reviewed for four staff members, three board officers and the individual identified as the owner. One interview was conducted with the owner via phone.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and the date to be corrected for each violation listed on the violation notice and return it to the department within 5 business days from receipt. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s); 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures.

Violations:
Standard #: 22.1-289-036-C
Description: Based on review of documentation received by the Department on December 14, 2023, an applicant for licensure has been convicted of at least one barrier crime as defined in ? 19.2-392.02 and has not been granted a waiver to receive a license to operate a child day center within the Commonwealth of Virginia.

Evidence:

1. Disqualifying documentation of a national criminal background check was received by the Department on December 14, 2023 for Applicant #1. The determination letter was dated December 13, 2023 and stated that Applicant #1 was ?Not Eligible?.
2. Applicant #1 stated during a phone interview on January 17, 2024, his responsibilities for the center included signing payroll checks, paying bills for the center, and maintaining the vans used by the center. Applicant #1 stated he is willing to sign over official ownership of the center to staff #1, the director, if needed to ensure continuous services for the community and children in care.

Plan of Correction: per the director:
1. Due to the owners Not Eligible status, The owner has agree to turn ownership of the center to the director. He will have no involvement nor responsibilities with the center's everyday operations.
2. Licensing informed director to wait for the finale decision by VDOE. The director plan of correction is to proceed with the steps of gaining complete ownership of the center. The center will operate under a new name.
