Comments:
A monitoring inspection was initiated and concluded on 02/20/2024. The inspector arrived at 1:15 PM and departed at 3:25 PM. There were 67 children present, ranging in ages from 2 years to 5 years, with 11 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 5 child records and 5 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program and discussed with the program director during the exit interview.

Violations:
Standard #: 22.1-289-036-B-4
Description: Based upon review of staff records, the facility has not ensured that they have obtained a copy of the results of a criminal history record information check, a sex offender registry check and a search of the child abuse and neglect registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. The record for staff 3 indicated that staff 3 resided in Tennessee within the preceding five years of hire. The facility has not obtained the results of a child abuse and neglect registry from Tennessee.
2. The record for staff 6 indicated that staff 6 resided in North Carolina and South Carolina within the preceding five years of hire. Results of the North Carolina child abuse and neglect registry were requested but no response was received. Results of the South Carolina criminal history record information and the child abuse and neglect registry search were not requested/obtained.

Plan of Correction: The facility responded with the following:

The results for TN have been received and added to the staff file.
The results for South Carolina have been requested.
The results for North Carolina have been requested a second time.

Standard #: 8VAC20-780-160-A
Description: Based upon review of staff records, the facility has not ensured that they have obtained results of a tuberculosis screening received within thirty days prior to employ of new staff.
Evidence:
The tuberculosis screening obtained for staff 6, employed on 2/5/2024, were obtained on 6/30/2023.

Plan of Correction: The facility responded with the following:
All staff have renewed their TB screening.

Standard #: 8VAC20-780-330-B
Description: Based upon digging in the areas under the playground equipment, the facility has not ensured that where playground equipment is provided, resilient surfacing shall comply with minimum safety standards when tested in accordance with the procedures described in the American Society for Testing and Materials (ASTM) standard F1292-99 as shown in Figures 2 (Compressed Loose Fill Synthetic Materials Depth Chart) and 3 (Use Zones for Equipment) on pages 6-7 of the National Program for Playground Safety's "Selecting Playground Surface Materials: Selecting the Best Surface Material for Your Playground," February 2004, and shall be under equipment with moving parts or climbing apparatus to create a fall zone free of hazardous obstacles.
Evidence:
The wood mulch under the large climbing structure, the tire swing, the swings, the mushroom stepping platforms, the cave climber and the small climbing structure has decayed to a measured depth of over six inches of soil/compost. The decayed/composted mulch no longer meets the ASTM standards for resilient surfacing.

Plan of Correction: The facility responded with the following:
Playground mulch is scheduled to be replenished the weekend of arch 16, 2024.
