Comments:
An unannounced monitoring inspection was conducted on 3/22/2024. The inspector was on site from approximately 10:28 am-2:16 pm. There were 120 children present, ranging in ages from 3 months to 6 years, with 21 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies, nutrition and background checks. A total of 10 child records and 10 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word corrected is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center did not ensure to request a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years by the end of the 30th day of employment for two staff as required.

Evidence:
1. The records of staff #1 (date of employment: 1/17/2024) and staff #3 (date of employment: 2/12/2024) contained sworn statements that indicated that the staff had resided outside of Virginia within the preceding 5 years. The records did not contain an out of state central registry request.
2. Administration acknowledged that the requests had not been completed.

Plan of Correction: *corrected* central registry requests have been submitted for both employees. Administration understands requirements for out of state search requests.

Standard #: 8VAC20-780-40-E
Description: Based on a review of documentation and interview, the center did not ensure to operate in compliance with their medication policies and procedures as required.

Evidence:
1. The center had an emergency long term medication for child #4 that expired 2/2024. Centers are required to have a procedure to include methods to prevent use outdated medication. The center's handbook stated that expiration dates would be checked. The administrator stated that this procedure included a check by both staff and parents.
2. Administration acknowledged that the medication expiration date was not checked and that the medication had expired.

Plan of Correction: *corrected* The expired medication has been replaced. A monthly audit of long term medications will be conducted.

Standard #: 8VAC20-780-270-A
Description: Based on observation and interview, the center did not ensure that areas and equipment of the center, inside and outside, were maintained in a clean, safe and operable condition.

Evidence:
1. On the infant/toddler playground, an area of the poured-in-place ground covering was observed that had a 10 inch wide and 4 inch deep gap that posed a tripping hazard.
2. Administration acknowledged that the areas required maintenance.

Plan of Correction: *corrected* The gap on the playground has been filled. Playground renovation plans are currently in progress.
