Comments:
An announced complaint investigation was conducted on February 20, 2024 with representatives of a local agency in response to a complaint regarding physical plant hazard. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. A report with findings was received from the local agency on March 21, 2024.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid.

Description: Based on observation and documentation review, the center did not ensure that areas and equipment of the center were maintained in a clean, safe and operable condition. Evidence:
1. In 2007, VDH advised that 3 children that attended the center had been reported to have lead poisoning. The center received a notice of violation from the Virginia Department of Health for having lead paint hazards. After painting both inside and outside, the facility received a letter of clearance to operate on July 5, 2007. The letter identified where the lead paint was located and stated that "the center needed to monitor for deterioration. Lead paint is still present in the dwelling and could present a danger if disturbed." The facility was advised that licensed lead contractors must be used for any future maintenance.
2. On January 10, 2024, the inspector observed several areas of the center with chipped and peeling paint within the reach of children in care.
3. VDH advised that the contractor used to paint the interior of the building was not a licensed lead contractor, as required.
4. On March 1, 2024, and March 7, 2024, VDH conducted lead paint testing and risk assessment at the center. Lead paint hazards were found at the front door, the foyer, both classrooms, pantry, kitchen, and the exterior of the building. Paint chips collected from the front sidewalk tested as lead based paint.

Plan of Correction: The equipment is clean and maintained. Any outside equipment that requires
additional absorbent material is not in use and does not present a hazard.

Complaint related: Yes
Description: Based on observation and documentation review, the center did not ensure when staff are supervising children, they always ensure their care, protection, and guidance. Evidence:
1. On February 14, 2024, a representative from the Virginia Department of Health (VDH) notified the licensing inspector that a child that attends the center has lead poisoning.
2. On February 20, 2024, the inspector, two representatives from the Richmond Office of VDH, and a center representative toured the center. The VDH representative pointed out several areas of the center where lead paint was present and compromised due to chipping and peeling. Several areas were within the reach of children in care.
3. Following the 2007 lead report from the Virginia Department of Health (VDH), the facility was advised by their inspector to ?continue to carefully monitor children when they are in areas containing the chipping peeling paint. The health department has instructed staff in appropriate cleaning procedures to reduce dust in the facility and it is expected that this practice become a part of the daily cleaning routine. Consultation was provided regarding adding these procedures to the already posted daily cleaning checklist.?
4. According to VDH, the center had not been following the cleaning procedures to minimize lead dust in the facility .

Plan of Correction: 1. There is no conclusive evidence as to where the child ingested lead paint. A notice will go home on to the parentsinforming them of the violations.
2. Three contractors approved by VDH were contacted and are providing proposals for removing the hazards.
3.The staff has been instructedin appropriate cleaning procedures to reduce dust in the facility and this practice has become a part of the daily cleaning routine. A checklist has been put in place.
