Comments:
A self-reported incident was received by the department on April 22, 2024, regarding a staff member grabbing a five year old's ankles, picking the child up and carrying the child upside down to the chair and locking the child's head in the staff's legs to change the child's pants. Interviews were completed with staff, staff files and written statements were reviewed.

The information gathered during this investigation determined non-compliance with applicable standards or law and two violations were documented on the violation notice issued to the program.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to the department within 5 business days from receipt. Please specify how the deficient practice will be or has been corrected. Please do not use staff names; list staff by positions only.

Violations:
Standard #: 8VAC20-780-400-B
Description: Based on interview and review of written statements, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. On 4/19/2024 at approximately 10:15am, Child #1 (5 years old) got raw eggs on her clothes while participating in an egg project. Child #1 refused Staff #1's instructions to go to the bathroom to change, got on the floor and kicked at Staff #1. In response, Staff #1 grabbed Child #1 by both ankles and carried Child #1 upside down approximately 3 or 4 steps before carrying her under her arm to the black chair near the bathroom. With the help of another staff person, Staff #1 forcibly changed Child #1?s dirty pants to clean ones.

Plan of Correction: Staff #1 was removed from classroom pending investigation report and
the parent was notified of the incident. Classroom staff were reminded of appropriate ways of behavioral guidance and strategies with extreme challenging
behaviors. County HR also notified for determining Staff #1 moving forward.

Standard #: 8VAC20-780-410-1
Description: Based on three staff interviews and review of written statements, a staff member used a forbidden action of rough handling a child in care and forcing a child to assume an uncomfortable position.
Evidence:
1. On 4/19/2024 at approximately 10:15am, Child #1 (5 years old) refused to follow instructions to go to the bathroom to change clothes and kicked at Staff #1 from the floor. Staff #1 grabbed Child #1 by both ankles and held Child #1 upside down while walking from the hexagon table approximately 3 or 4 steps before carrying her under her arm to the black chair near the bathroom. Staff #1 sat down in the chair, put Child #1?s head in between her lower legs and held Child 1's legs while she took off the child's pants and another staff put clean pants on her. Child #1 was crying during the incident.

Plan of Correction: In addition to Staff #1 being removed from classroom and working
with children pending the report, classroom staff were reminded of
forbidden actions when working with children and strategies for
guiding behaviors.
