Technical Assistance:
Discussed in detail (8VAC20-780-34 D) as it relates to each grouping of children having at least one staff member who meets the qualifications of a program leader or program director and any related exceptions. .

Comments:
An unannounced monitoring inspection was started in the center on April 30, 2024, from 3:20 PM until 5:20 PM and concluded on May 1, 2024. At the time of entrance, 25 children were in care with 2 staff members. The sample size consisted of 5 children?s records and 4 staff records. Children were observed during nap time, freely playing and eating snack.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-40-E
Description: Based on observation and staff interviews, the licensee did not ensure to follow the terms of the current license issued by the department.

Evidence: The center?s license is for ages 2 years and 6 months through age 12 years and 11 months. The center had two children Child #1 and Child #5, who attended the center when they were less than 2 years 6 months old. Child #1 started attending the center on 8-28-2023 and they were age 2 and 1 month old and Child #5 started attending on 7-11-2023 and they were 23 months old. The center operated outside the terms of their license by providing care for children under age 2 years 6 months.

Plan of Correction: Ensure all children that are enrolled in the program are at least 2 years, 6 months of age

Standard #: 8VAC20-780-40-L
Description: Based on staff interviews and children?s record review, the licensee did not ensure to inform all staff who work with children of children's allergies, sensitivities, and dietary restrictions.

Evidence: Child #4 has a documented food sensitivity from a physician (milk). Staff #1, Staff #2 and Staff# 3 who were all supervising Child #?4 were unaware of the child's food sensitivity.

Plan of Correction: Staff was updated on children's allergies and food sensitivities

Standard #: 8VAC20-780-40-M
Description: Based on observation and staff interviews, the licensee did not ensure the center shall maintain, in a way that is accessible to all staff who work with children, a current written list of all children's allergies, sensitivities, and dietary restrictions. This list shall be dated and kept confidential in each room or area where children are present.

Evidence: Child #5 has a documented food sensitivity (cow?s milk) and it was not on the list of children's allergies, sensitivities and dietary restrictions

Plan of Correction: Allergy lists were updated and posted in the classroom. Moving forward, allergy lists will be checked on a monthly basis to ensure they are up to date.

Description: Repeat
Based on record review and staff interviews, the licensee did not ensure each staff record contained all required documentation.

Evidence: Staff #4 verified the following items were missing from the staff records;
1.Staff #1, #2 #3 and #4 did not have documentation of any health-related problems that my interfere with the job.
2.Staff #4, the designated Program Director did not have documentation to demonstrate that the individual possesses the education, certification, and experience required by the job.

Plan of Correction: 1. Employee files were updated to include documentation of health related problems.
2.Progmra Director file will be updated.

Standard #: 8VAC20-780-80-A
Description: Based on documentation review and provider interview the licensee did not ensure that for each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.

Evidence: At approximately 3:20 PM, 25 children observed in the preschool room and 26 children were on the attendance list. Center staff verified, Child #4 had left around 12:30 PM and it had not been marked on the attendance list.

Plan of Correction: Staff was reminded to sign children out as they left for the day

Based on a record review and staff interviews, the licensee did not ensure that staff have completed the Virginia Department of Education (VDOE)-sponsored orientation course within 90 calendar days of employment.

Evidence: Staff #2 confirmed they began working in July 2023 there was not documentation of completing the VDOE orientation.

Plan of Correction: All staff will complete the updated Health and Safety Courses

Description: Based on documentation review and staff interviews, the licensee did not ensure to obtain an annual approval from the health department.

Evidence: Staff #4 confirmed the most recent copy of the health inspection available for review was dated 12-7-2022.

Plan of Correction: health department will be contacted to setup health inspection.

Standard #: 8VAC20-780-290-A-2
Description: Based on observation and staff interviews, the licensee did not ensure that in areas used by children of preschool age or younger, fans, when used, shall be out of reach of children and cords shall be secured so as not to create a tripping hazard.

Evidence: There was a tall oscillating fan that was plugged into the wall and turned on and placed near the cubbies and table used for children?s activities. The fan was accessible to the children and the cord poses a tripping hazard.

Plan of Correction: Removed fan from classroom

Standard #: 8VAC20-780-450-A
Description: Based on observation and staff interview, the licensee did not ensure cots/mats used by children other than infants during the designated rest period shall have linens consisting of a top cover and a bottom cover or a one-piece covering which is open on three edges.

Evidence: Two children out of twenty-five were observed sleeping without a bottom cover.

Plan of Correction: Staff will ensure all children have top and bott covers during rest periods.

Standard #: 8VAC20-780-500-A
Description: Based on observation and staff interviews, the licensee did not ensure children's hands shall be washed with soap and running water or disposable wipes when required.

Evidence: Children were observed eating snack and none of them washed their hands with soap and running water or disposable wipes before eating.

Plan of Correction: Staff will ensure all children will wash their hands directly before eating.

Standard #: 8VAC20-780-530-A
Description: Based on record review and staff interviews, the licensee did not ensure there was at least one staff in each classroom or area where children are present that had obtained a current certification in cardiopulmonary resuscitation (CPR) and First Aid as appropriate to the age of the children in care.

Evidence: Staff #1 and Staff #2 were observed as the only persons supervising 25 children in the preschool and they do not have a certification in CPR or First Aid. There was not a staff member in the preschool with First Aid and CPR certification.

Plan of Correction: All current staff will have CPR/First Aid training. Moving forward, new staff will be required to obtain CPR/First Aid training certification with 30 days

Description: Based on record review and staff interviews, the licensee did not ensure there was at least one staff in each classroom or area where children are present that had obtained a current certification in cardiopulmonary resuscitation (CPR) as appropriate to the age of the children in care

Evidence: Child #1 was observed walking around eating their snack (pretzels).
