Technical Assistance:
Technical assistance was provided, and licensing standards were reviewed regarding playground safety. The focused monitoring inspection was reviewed.

Comments:
An unannounced focused monitoring inspection was conducted on May 1, 2024, from 9:30am to approximately 11:15am. At the time of the inspection there were 24 children in care and 8 staff. The inspectors were able to observe children participating in free play both indoors and outdoors, handwashing, diapering, and room transitions. Records were reviewed for two children and two staff members. The information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice and discussed with the owner and administrator during the exit interview.

Violations:
Standard #: 22.1-289.035-B-2
Description: REPEAT VIOLATION
Based on record review and interview, it was determined that the center did not ensure that the criminal history records check is received prior to the first day of employment.
Evidence:
1. Two staff members were working with children prior to their criminal history records check being received by the center.
a. Staff #2 (date of hire 04/16/2024) has a criminal history records check dated 4/26/2024, which is 10 days after their start date working with children.
b. Staff #3 (date of hire 04/22/2024) has a criminal history records check dated 4/29/2024, which is 7 days after their start date working with children.
2. Staff #1 confirmed that both Staff #2 and Staff #3 started working with children prior to their criminal history record checks were received.

Plan of Correction: The center responded with the following: The center will ensure that all criminal background checks will be received prior to the staff working with children.

Standard #: 8VAC20-780-140-A
Description: Based on record review and interview, it was determined that the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within 30 days after the first day of attendance.
Evidence:
1. Child #1 (date of enrollment 2/20/2024) did not have a physical examination in their record by their physician.
2. Staff #1 confirmed that Child #1 did not have a physical examination in their record.

Plan of Correction: The center responded with the following: The center message the mother via the app and requested that the physical be brought in for the child?s file. The staff will also remind the parent at pick up to bring the child?s physical examination for their record.

Standard #: 8VAC20-780-270-A
Description: REPEAT VIOLATION.
Based on observation and interview, it was determined that the center did not ensure that areas and equipment of the center, inside and outside, were maintained in a safe and operable condition.
Evidence:
1. In the 4 year old classroom, there is a long loose baseboard along the wall with protruding nails and an unstable bookshelf that are accessible and in the reach of children in care. This poses as an injury hazard.
2. In the school age room, the medal bracket on the floor to seal the front door is loose and is a tripping hazard to the children in care.
3. In the playground, there are two large 12-inch holes in the ground that the children can trip or injury themselves while playing on the playground.

Plan of Correction: The center responded with the following: The baseboards will be fixed and drilled into the wall. The Unstable bookshelf will be removed from the classroom. There will be a work order for the medal bracket to be fixed. The two holes in the ground will be filled with sand and dirt.

Standard #: 8VAC20-780-570-B
Description: Based on observation and interview, it was determined that the center did not ensure that bottle fed infants who cannot hold their own bottles shall be held when fed. Bottles shall not be propped or used while the child is in his designated sleeping location.
Evidence:
1. An infant was lying down on a baby bouncer with a bottle propped up with a pillow.
2. Infant staff confirmed to propping the bottle with a pillow for an infant child to be fed.

Plan of Correction: The center responded with the following: Staff will no longer prop bottles for the infants that cannot hold their own bottles but will hold the children while being fed.
