Discussed with Director and Admin personnel: Documentation requirements for staff records, background search requirements.

Comments:

This Inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia. An initial inspection was initiated on 6/17/21 and concluded on 6/17/21. The director was contacted by phone to initiate the inspection. There were no children present. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 4 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliances with applicable standards or law and violations were documented on the violation notice issued to the facility. Violations:

Standard #:	22VAC40-185-160-A
Description:	Based on a review of records, staff records do not contain documentation of a current results for a TB test or screening. Evidence: Staff #1- TB results are dated 3/14/2020.(Expired, more than 12 months old). Staff #2- There are no TB results on file.
Plan of Correction:	Documentation will be located for Staff #2. Staff 1 will obtain a new screening result. Moving forward staff will provide documentation annually.
Standard #:	22VAC40-185-70-A
Description:	Based on review of records, staff records do not include documentation of all required components. Evidence: 2 of 4 record reviewed did not contain documentation of references before employment. *Staff #1 has no references available for review. *Staff #4's phone references are dated 6/14/21, and 6/15/21. (Date of Hire: 6/3/21)
Plan of Correction:	References will be retrieved from the corporate office database. Moving forward a new process will be in place for VA sites.
Standard #:	22VAC40-191-60-B
Description:	Based on a review of records, staff records do not include documentation of a completed Sworn Disclosure Statement (SDS) on file prior to employment. Evidence: Staff #1 (Date of Hire: (DOH) 5/17/21) SDS is dated 6/11/21. Staff #2 (DOH: 3/27/21) SDS is dated 6/1/21. Staff #3 (DOH: 6/16/21) SDs is not signed and dated.
Plan of Correction:	*Staff #3's form "shifted" when it was uploaded and doesn't show the date or signature. A new form will be completed. *A new form will be used for all staff moving forward. The forms will be signed, dated correctly and uploaded.
Standard #:	22VAC40-191-60-C-2
Description:	Based on a review of records, one staff record does not contain documentation of a completed Central Registry Search (CPS) within 30 days of employment, Evidence: Search results on file were previously disseminated, and are not able to be used for the new employer. (Staff #2).
Plan of Correction:	A new search will be sent off.
Standard #:	63.2(17)-1720.1-B-2
Description:	Based on a review of records, staff records do not include documentation of a completed nationwide fingerprint search prior to employment. Evidence: *Staff #1 (DOH: 5/17/21) Fingerprint results are dated 6/11/21. *Staff #2 (DOH:3/27/21) Fingerprint results are dated 6/14/21.
Plan of Correction:	We have received clarification on the requirements for documenting hire dates. Staff will not be hired until all required documents are on file.
Standard #:	63.2(17)-1720.1-B-4
Description:	Based on a review of records, staff records do not contain documentation of all required background searches for those staff persons who have resided outside of the state of Virginia in the past 5 years. Evidence: Staff #1 (DOH: 5/17/21) Sex Offender Search results are dated 6/11/21. Staff #2 (DOH: 3/27/21) Sex Offender search results are dated 6/11/21 (MD), 6/17/21 (CA), CPS search results are not on file for MD. CA results are documented as 6/11/21.
Plan of Correction:	No staff will be hired without all require background searches on file.
