Technical Assistance:
Today we discussed revisiting the policy and procedure manual / Emergency Plan in terms of actions to take in the event of a serious injury.
The Injured Child Section addresses calling 911 / contacting the Emergency Medical Services. However, it does not give instruction on under what circumstances or how to determine if 911 / EMS should be contacted.

Comments:
A monitoring inspection was initiated on 8/16/2022 and concluded on 9/7/2022 in response to two serious injury reports received by the department on 8/12/2022. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, and special care and emergencies.

Documentation to include written incident reports for both children involved and written emergency procedures were reviewed. Seven staff who were involved and / or witnessed portions of the events were interviewed

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-780-80-B-2
Description: Based on a review of documentation and interviews, the licensee failed to inform the department's representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.

Evidence:
The department received two serious injury reports that were reported by the licensee via the online portal on 8/12/2022.

The first incident involved an 8 year old child who consumed a food preservative packet labeled "Do not eat". Poison Control was contacted for guidance on what, if any, actions needed to be taken. The incident occurred on 8/8/2022 and was reported to the Deapartment 4 days later.

The second incident involved a 7 year old child who was hit in the back of the head with a piece of brick resulting in a deep cut requiring stitches. This incident occurred on 8/9/2022 and was reported to the Department 3 days later.

The licensing inspector was present at the facility on 8/9/2022 after both incidents had occurred, but was not made aware that two serious incidents requiring outside medical attention had occurred.

Neither incident requiring outside medical attention were reported to the department within the required 2 business day time frame.

Plan of Correction: The licensee will submit their plan of correction response within 10 days of receipt of the inspection report dated 9/7/2022 (by 9/17/2022).
