22VAC40-665 INTRODUCTION

Technical Assistance:
Today we discussed the requirements for background checks (National Finger print Criminal Records Search, Search of the Central Registry, Sworn Statement or Affirmation), how to obtain them, and the requirements for updating then every 5 years. Contact Information for the office of background checks (OBI) was given to the vendor - (804) 726-7844. You will need to contact them first for your identification number and schedule the fingerprinting on line, per their instructions. (more instructions are on supplemental page). Please send documentation that the unmet requirements pertaining to background checks have been corrected within10 DAYS of the inspection. Corrections can be documented with a picture or receipt - scanned and/or emailed, faxed, or delivered in person to the Licensing Office. Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Childcare Centers was conducted on 5/2/19 from 12:30 p.m to 2:30 p.m. At the time of arrival the following staff to child ratios were observed: 7 children, 1 year old, with 2 staff 4 children, 1 year old, with 2 staff 10 children, 2 years old, with 2 staff 10 children, 2 years old, with 2 staff 8 children, 2 years old, with 2 staff 11 children, 3 years old, with 2 staff 9 children, 3 years old, with 2 staff 6 children, 4 years old, with 1 staff Classrooms were inspected, staff/child observations were made and children were observed. Children were observed eating lunch (which they bring from home), Playing outdoors, creating art, and resting quietly on cots at nap period. Restroom procedures, hand washing and table sanitizing were also observed. 12 staff records were reviewed, handbooks and policies were reviewed and staff was interviewed regarding center policies and procedures. The facility, to include all indoor areas used by children in care, as well as the outdoor play space were inspected. The administrator reports that the program does not transport children in a vehicle. Medication is administered as needed by MAT trained staff with written parent authorization and instructions. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of records and interview, the religious exempt preschool program has not had staff submit to fingerprinting and provide personal descriptive information described in subdivision B 2 of ? 19.2-392.02 of the code of Virginia in order to obtain a National Finger print based criminal record check. Evidence: Twelve (12) staff records for the program were reviewed. None of the 12 records for staff currently working in the preschool contained results of a National Finger print based background check. Each of the staff records contained a "Virginia State Police criminal record check". Staff #6, stated that they were not aware that the background check requirements had changed and that they had to be obtained through a specific agency and that these background checks now require fingerprinting.

Plan of Correction: Staff #6 stated that she will ensure that each staff person submits to fingerprinting through the Office of Background Check Investigations (OBI), according to the instructions supplied during today's inspection. The results of these background checks will be forwarded to the agency within 10 days.
