Technical Assistance:
Today we reviewed requirements for background checks to include that staff may not be employed in any capacity prior to receipt of results of the Federal Background Check results. In addition, we reviewed the requirement that staff who have resided outside of the state of Virginia with in the past 5 years must obtain, within 30 days of employment, results of a Search of the Central Registry from the other state(s) where they resided during that time frame. Please send documentation that the unmet requirements pertaining to background checks have been corrected WITHIN 10 DAYS OF THE INSPECTION. Corrections can be documented with a picture or receipt - scanned and emailed, faxed, or delivered in person to the Licensing Office. Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Childcare Centers was conducted on 6/10/19 from 1:00 p.m. to 3:50 pm. At the time of arrival the following staff to child ratios were observed: 9 children, two years old, with 1 staff (napping) 17 children, two years old, with 1 staff (napping) 8 children, 16 months to two years old, with 3 staff (napping) 8 infants, 13 to 15 months old, with 2 staff 6 infants, 6 to 12 months old, with 2 staff 20 pre-k/ preschool children (3 to 5 years old) with 1 staff (napping) 10 pre-k children (3 to 4 years old) with 1 staff (napping) Additional staff were available in the building to assist as needed and 2 way radios were available for communication between staff. The records sample size consisted of 13 staff records. Classroom observations were made and children were observed. Infants were observed crawling and toddling, being held and bottle fed, sitting in infant activity and bouncy seats. Older children were sleeping or resting quietly during nap period. Thirteen staff records were reviewed, handbooks and posted information were reviewed and the center director was interviewed regarding center policies and procedures. The facility, to include all indoor areas used by children in care, as well as the outdoor play space were observed. Staff report that the program does occasionally transport children to and from school for before and after care. No medication is a being administered at this time. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance.

Description: Based on a review of records and interview, the religious exempt child care program did not ensure that each staff submits t o fingerprinting for the purposes of completing a Federal Criminal Background check. Evidence: 13 staff records were reviewed during the inspection. The record for staff #7 did not contain the results of a Federal Criminal Background check (fingerprinting). The record for staff #7 did contain the results of a Virginia State Police background check which had been conducted 11/12/15. Staff #14 (director) stated that she was unable to locate the results of a Federal Criminal Background check (fingerprinting during the inspection.

Plan of Correction: The director stated that she would have staff #7 make an appointment today to have her fingerprints taken. The results of the Federal Criminal Background check (fingerprinting) will be forwarded to the inspector as soon as they are received by the director.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of records and interview, the religious exempt child care program did not obtain a copy of the results of a search of the central registry maintained pursuant to ? 63.2-1515 and any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years. Evidence: 13 staff records were reviewed during the inspection. The record for staff #4 contained a Sworn Disclosure Statement that stated that staff #4 had resided in North Carolina, Alaska and Oklahoma within the past 5 years. The record for staff #4 did not contain the results of an investigation as to whether any any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years contains any founded complaint of child abuse or neglect against her. Staff #14 (director) stated that she was unable to locate any documentation of the other states' abuse and neglect registry having been requested.

Plan of Correction: The director stated that she would contact the 3 out of state agencies this week to request a search of their child abuse and neglect registry or equivalent registry. Once results are obtained by the director, they will be forwarded to the inspector.
