Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Childcare Centers was conducted on June 20, 2019 from 10:20 a.m to 1:35 pm. At the time of arrival the following staff to child ratios were observed: 3 infants with 2 staff 9 infants and toddlers, ages 1 1/2 to almost 3 years old, with 4 staff 9 children, two years old, with 1 staff 6 children, two years old, with 1 staff 10 children, three years old, with 1 staff 8 children, three years old, with 1 staff 15 children, four years old, with 2 staff 7 children, 10-12 years old, with 1 staff 7 children, 6-8 years old, with 1 staff 4 children, 5-7 years old, with 1 staff 5 children, 6-7 years old, with 1 staff The records sample size consisted of 21staff records. Classroom observations were made and children were observed playing in learning centers and outdoors, creating art, being assisted with changing out of water-play clothes, watching a children's program on television, and being read to from children's literature. Infants were having floor time and playing with toys. Family Handbooks and web site information were reviewed and the center assistant director was interviewed regarding center policies and procedures. The facility, to include all indoor areas used by children in care, as well as the outdoor play space were observed. Staff report that the program does transport children in a vehicle and does administer medication. Applicable requirements were reviewed. Areas of non-compliance are identified on the violation notice. Thank you for your time during today's inspection. Please do not hesitate to contact me if I may be of assistance.

Standard #: 22VAC40-191-40-D-2
Description: Based on a review of records and interview, the center was unable to demonstrate that the center is in compliance with the following: Search of central registry results within 30 days of employment or commencement of service. Evidence: Twenty-one staff records were reviewed. The records for staff ##1, #2, #3, #4, #5, #7, #8, #9, #10, #11, #12, #14, #15, #16, #17, #18, #19, #20 and #21 did not contain results of a search of the central registry. There was documentation available showing that a request had been mailed out for staff #2, #4, #5, #9, #10, #12, #16, and #20 in two batches on 2/11/18, 3/14/19, however, documentation showing that the department had been contacted after the first 30 days and each 30 days thereafter was not available. Staff #22, who was able to locate much of the required documentation today, confirmed that these were not located during the inspection. Due to the absence of the business administrator for the center and the temporary relocation of the offices in the center during renovations, it was undetermined whether this documentation had been obtained or not.

Plan of Correction: Staff #22 stated that she felt sure the documentation was present but was unable to locate it during the inspection. Staff #22 stated that she will try to locate the missing central registry checks and if the business administrator is not able to provide them, follow up with the agency to request results will be implemented or new requests will be completed and sent. Results will be forwarded to the Virginia Department of Social Services inspector upon receipt.

Description: Based on a review of records and interview, the center was unable to demonstrate that the center obtained a copy of the results of a search of the central registry or any child abuse and neglect registry or equivalent registry maintained by any other state in which the individual has resided in the preceding five years for any founded complaint of child abuse or neglect against him. Evidence: Twenty-one staff records were reviewed. The records for staff #1 and #15 contained a Sworn disclosure statement or affirmation form that declared that they had resided outside of the state of Virginia within the last 5 years. The documents indicated that staff #1 resided in Illinois, Maryland and Florida in the past 5 years and staff #15 resided in St. Croix and US Virginin Islands within the past 5 years. There was no documentation available showing that a request to the applicable states' child abuse and neglect registry had been requested for staff #1 and staff #5 Staff #22, who was able to locate much of the required documentation today, confirmed that documentation of requests for the applicable states' child abuse and neglect registry were notable to be located during the inspection. Due to the absence of the business administrator for the center and the temporary relocation of the offices in the center during renovations, it was undetermined whether this documentation had been obtained or not.
