Today we discussed the requirements for out of state Search of the Central Registry checks for staff who disclose having lived outside of the state of Virginia in the past 5 years. This link will connect you with the Adam Walsh State Contact for Child Abuse Registries: http://www.cdss.ca.gov/Portals/9/CCLD/Revised%20AW%20Contact%20List.pdf?ver=2017-04-03-084448-420 This registry includes contact information for each state along with the procedures, forms, and fees needed to complete the search. If a response is not received within 45 days, contact the agency again for guidance and continue to follow up until a response is obtained. The results of a Fingerprint Based Federal Background Check must be obtained PRIOR to the hiring of a staff who will supervise children. A Sworn Disclosiure or Affirmation form must be completed and signed by staff prior to their first day of employment or service. Results of a Search of the Central Registry must be obtained within 30 days of hire. Today we discussed the use of a fan in rooms where children are present when classrooms are warm. Fans may be used if they are done so in a manner that protects children from Touching / putting fingers in the protective grate and does not place the fan on a surface where it could be pulled over onto a child either by knocking it over or pulling it over by the cord. Please send documentation that the unmet requirements pertaining to background checks have been corrected WITHIN 10 DAYS OF THE INSPECTION. Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Child Day Centers was conducted on 7/1/19 from 11:30 a.m. to 2:30 pm. At the time of arrival the following staff to child ratios were observed: 4 children, 7 to 11 months old, with 1 staff 10 children, 12 to 24 months old, with 3 staff 9 children, 3 to 4 years old, with 1 staff 13 children, 5 to 11 years old, with 2 staff The records sample size consisted of 18 staff records. Classroom observations were made and children were observed playing in learning centers, resting at nap time, being held and cuddled, eating lunch - brought from home, playing outdoors and watching a children's movie. Restroom procedures and handwashing were observed during the inspection. Staff records were reviewed, posted information was reviewed and the center director staff was interviewed regarding center policies and procedures. The facility, to include all indoor areas used by children in care, as well as the outdoor play space were observed. The center director reports that the program does not routinely transport children in a vehicle. Medication Administration Trained (MAT) are available to administer medication with written parental consent. Areas of non-compliance are identified on the violation notice. Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of records and interview, the center was unable to demonstrate that every staff had submitted to fingerprinting and provided personal descriptive information described in subdivision B 2 of ? 19.2-392.02 for the purpose of having a federal criminal records search conducted.
Evidence:
The staff records for (all) 18 staff who are currently employed in the exempt program were reviewed.
The record for staff #3 did not contain the results of a fingerprint based federal criminal records check.
The program director (#19) confirmed that this documentation was not available and that staff #3 had recently returned from school to work in the summer program, had worked in the summer program several weeks ago and had not yet been fingerprinted.

Plan of Correction: The program director (#19) sent staff #3 to have fingerprinting conducted during the inspection today. Results will be kept on file in the program's staff records.
