Technical Assistance:
Today we discussed the requirements for background checks (National Finger print Criminal Records Search, Search of the Central Registry, Sworn Statement or Affirmation), how to obtain them, and the requirements for updating then every 5 years. Contact Information for the office of background checks (OBI) was given to the vendor - (804) 726-7844. You will need to contact them first for your identification number and schedule the fingerprinting on line, per their instructions. Corrections can be documented by forwarding emailed results, scanned and/or faxed, or delivered in person to the Licensing Office. Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Childcare Centers was conducted on 7/10/2019 from 12:30 p.m to 2:30 p.m. At the time of arrival the following staff to child ratios were observed: 6 children, ages 2 to 5 years old, with 1 staff A second staff arrived during the inspection Classrooms were inspected, staff/child observations were made and children were observed resting quietly on cots at nap period. Two staff records were reviewed, postings and policies were reviewed and staff was interviewed regarding center policies and procedures. The facility, to include all indoor areas used by children in care, as well as the outdoor play space were inspected. The administrator reports that the program does not transport children in a vehicle while they are in care. Areas of non-compliance are identified on the violation notice. Standard #: 22VAC40-191-40-D-2
Description: Based on a review of records and interview, the religious exempt preschool program was unable to demonstrate that the center is in compliance with requirements that all prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center except a parent-volunteer, or a parent or guardian who may be left alone with his or her own submits and has on record the following documentation of required background checks: Search of central registry within 30 days of employment or commencement of service. Evidence: Two staff records for the program were reviewed. Neither of the records for the two staff working directly with children (#1, #2) contained results of a Search of the Central Registry. Staff #1 confirmed that this documentation was not available and stated that she was not aware of the requirement for Central Registry searches for staff but thought she was meeting this requirement with the State Police background checks she has been obtaining.

Plan of Correction: Staff #1 completed the requests for Central Registry Checks for both staff during the inspection and will send them out this week. The results will be forwarded to the inspector at the time that they are received from the agency and within 10 days.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on a review of records and interview, the religious exempt preschool program has not had all staff submit to fingerprinting and provide personal descriptive information described in subdivision B 2 of ? 19.2-392.02 of the code of Virginia in order to obtain a National Finger print based criminal record check. Evidence: Two staff records for the program were reviewed. The record for staff #2 who is currently working in the preschool contained results of a National Finger print based background check. Staff #2's record did contain the results of a "Virginia State Police criminal record check" which met the requirement up until October 2018. Staff #1, confirmed that the documentation was not available for staff #2 and stated that she only recently became aware that the background check requirements had changed and that they had to be obtained through a specific agency and that these background checks now require fingerprinting. Staff #1 stated that she intended to send staff #2 to have the fingerprints processed after she had completed her own, but had not yet done so.

Plan of Correction: Staff #1 stated that she will ensure that staff #2 (and any future employed staff prior to hire) submit to fingerprinting through the Office of Background Check Investigations (OBI), according to the instructions supplied during today's inspection. The results of these background checks will be forwarded to the agency within 10 days.
