63.2(17) License & Registration Procedures

Comments:
An unannounced monitoring inspection was conducted at Lighthouse Baptist Church on 7/16/19 from 11:30 am until 1:30 pm to review the religious exempt requirements. At the time of the inspection 10 staff were present with 41 children. Children and staff were observed during lunch preparations, lunch, bottle feeding, nap, bathroom break, hand washing, transitions and behavioral guidance. Violations were found during this inspection and are documented on the violation notice. If you have questions or concerns contact the licensing inspector at (540) 292-5933 for further assistance.

Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to ensure all staff completed a central registry record check within 30 days of employment. Evidence: 1. The records of five staff were reviewed. Staff 1's record did not contain a search of central registry. Staff 1's start date was 8/15/16. 2. The director stated staff 1 started working at their elementary school and when she moved to working at the religious exempt portion of the school she assumed they completed all the same background checks. At this time she does not have access to the files in the school to check since they are closed for the summer.

Plan of Correction: Staff 1 will be required to complete the paperwork to be mailed within five days. In the future the director will ensure all required background checks are completed.

Standard #: 63.2(17)-1716-A-9
Description: Based on observation and interview, the center failed to ensure safe sleep guidelines recommended by the American Academy of Pediatrics which advises babies should sleep on their backs on a flat surface free of blankets, pillows, or other soft items until the age of 1 to reduce the risk of SIDS. Evidence: 1. In the crawler room two cribs were observed with blankets in them. 2. The teacher stated one of the cribs belongs to a child that is over one-year-old and the other belongs to child 6 and he is nine months old.

Plan of Correction: The parents of child 6 will be advised a blanket will no longer be permitted in the crib. All staff will be trained to ensure babies sleep on their backs on a flat surface free of blankets, pillows, or other soft items until the age of 1 to reduce the risk of SIDS.

Standard #: 63.2(17)-1716-B-3
Description: Based on record review and interview, the center failed to ensure that a daily simple health screening and exclusion of sick children was completed by a person trained to perform such screenings. Evidence: 1. The records of five staff were reviewed. A training certificate for daily health screening dated 6/26/19 was found in staff 5's record. 2. The director stated they have a policy in which all staff complete a daily health screening as they arrive each day and throughout the day as needed. No staff was trained prior to 6/26/19.

Plan of Correction: All staff are required to complete the daily health screening training by 8/12/19. All new staff will be required to complete the training upon hire.

Standard #: 63.2(17)-1716-B-5
Description: Based on interview, the center failed to establish and implement procedures to ensure that all areas of the premises accessible to children are free of obvious injury hazards, including providing and maintaining cushioning material under playground equipment. The director stated they do not provide cushioning material under the swings.

Plan of Correction: The children will not be allowed to play on the swings until cushioning material is added.

Standard #: 63.2(17)-1716-B-6
Description: Based on record review and interview, the center failed to establish and implement a procedure to ensure all staff are able to recognize the signs of child abuse and neglect. Evidence: 1. The records of five staff were reviewed. Three staff records had no documentation of completing training in recognizing child abuse and neglect. 2. The director stated staff were advised in June to complete the training by 8/12/19.

Plan of Correction: All staff will by trained by 8/12/19 when the regular school year starts. All future staff will be required to complete the training prior to working with children.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center failed to ensure a staff member who resided outside of VA within the past five years request an out-of-state child abuse and neglect search by the end of the 30th day of employment.

Evidence:

1. Five staff records were reviewed. Documentation in staff 3's record shows residence in WV within the last five years. There was no documentation in the record of a child abuse and neglect registry search being completed in WV.
2. The director was unaware of this requirement and verified a WV child abuse and neglect registry search has not been completed for staff 3.

Plan of Correction: The WV child abuse and neglect registry search will be mailed for staff 3 within five days. All staff will be asked if they have lived outside of VA in the last five years and if they have a registry search will be completed for them also. In the future all new staff will be asked if they have lived outside of VA in the last five years and a registry search will be completed.
