63.2(17) License & Registration Procedures

Comments:
An unannounced "Code of Virginia Section 63.2-1716" compliance monitoring inspection was conducted on July 17, 2019 from 10:00 a.m. to 1:45 p.m. 28 children, ages 8 months through 14 years old, were under the care and supervision of 6 staff. Center documents and seven staff records were reviewed. Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on review of documentation and interview with staff, the center failed to ensure documentation of sworn statement or affirmation by the first day of employment and central registry background check results within 30 days of employment. Evidence: Staff A, start date 6/26/2015, did not have documentation of sworn statement or central registry background checks. Staff B, start date 7/10/2017, did not have documentation of sworn statement or central registry background checks. Staff C, start date 7/6/2015, did not have documentation of sworn statement or central registry background checks. Staff D, start date 10/9/2017, did not have documentation of sworn statement or central registry background checks. Staff E, start date 10/4/2017, did not have documentation of sworn statement or central registry background checks. Staff F, start date 6/1/2019, did not have documentation of sworn statement or central registry background checks. Staff G, start date 6/3/2019, did not have documentation of sworn statement or central registry background checks.

Plan of Correction: All staff will complete sworn statements as soon as possible. Central registry background checks will be completed as soon as possible. In the future, all background checks will be conducted within required time frames.

Standard #: 63.2(17)-1716-A-3-a
Description: Based on observation, the center failed to ensure there was one staff person assigned for four children ages birth through 16 months old. Evidence: There was an 11 month old infant asleep in a playpen in a very dark room alone with the door closed. There was an 8 month old infant asleep in an infant swing in a second dark room alone with the door closed. There was one staff member located in the hallway with an awake 8 month old infant. Staff are counted in the staff to children ratios only when they are directly supervising children.

Plan of Correction: We use video monitors to monitor the children and thought this was sufficient to meet the ratio. In the future, staff will be present in the room with the sleeping children.

Standard #: 63.2(17)-1716-A-3-f
Description: Based on observation, the center failed to ensure there was one staff person assigned for every 25 children ages 9 through 14 years of age. Evidence: There was not an assigned staff for the 9 years through 14 years age group.

Plan of Correction: This is a new requirement and we will make adjustments to our staffing assignments.

Standard #: 63.2(17)-1716-A-6
Description: Based on review of documentation and interview with staff, the center failed to provide a written statement describing the physical facilities of the center.

Plan of Correction: This information will be updated as soon as possible.

Standard #: 63.2(17)-1716-A-8
Description: Based on observation and review of documentation, the center failed to ensure compliance with the safe sleep guidelines recommended by the American Academy of Pediatrics (AAP). Evidence: 1. In the "Staff Daycare Policy Handbook" it lists: Sleep: Children ages zero to 28 months: "Additional sleep needs (stuffed animal, ... etc) may be sent from home. 2. An 11 month old was observed in a playpen with a "wubbanub" brand pacifier and a soft toy "lovey". The AAP recommendations state to "avoid use of soft bedding, including soft toys" 3. An 8 month old infant was observed sleeping in an infant swing. The AAP recommendation is "place baby on his/her back on a firm sleep surface such as a crib or bassinet with a tight-fitting sheet.

Plan of Correction: In the future, the American Academy of Pediatrics recommendations will be followed.

Standard #: 63.2(17)-1716-B-5
Description: Based on observation and interview with staff, the center failed to ensure that there was a procedure for maintaining cushioning material under playground equipment. Evidence: There is an octagon climber, a see-saw and several little tyke climbers and a little tyke slide that have grass underneath. There is no cushioning material on the playground.

Plan of Correction: Cushioning material will be added to the play area as soon as possible and a policy will be implemented regarding the maintenance of it.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on review of documentation, the center failed to ensure that out of state central registry background checks were requested by the 30th day of employment for any staff that has resided outside of the state of Virginia within the last 5 years. Evidence: Staff E, start date 10/4/2017, indicated residence in Missouri in the last 5 years and there was no Missouri central registry background check in the record.

Plan of Correction: Out of state central registry background checks will be requested for any staff that have lived outside of Virginia in the last 5 years.
