Technical Assistance:
An exit interview was conducted with the director to discuss the results of today's inspection. Consultation was given regarding updated regulations in child/staff ratios, CPR certification, out of state searches, and accessing the department's website for notices, forms, and additional information. A copy of the new regulations was given to the director during this inspection.

Comments:
An unannounced monitoring inspection was conducted today, July 17, 2019 to determine the center's compliance with religious exempt requirements. The inspection was initiated at 3:10pm and concluded at approximately 5:30pm. Today approximately 19 children were in attendance being supervised by two staff. Administrative records, children's classrooms, restrooms, outdoor play areas, and common areas were inspected. See attached notice for violations found during this inspection. Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on the inspection of staff records, the required central registry background check was not available to review. Evidence: During the inspection of two staff records and interview with the administrator, it was discovered staff #1 did not have a central registry background check in the record. Religious Exempt requirements stipulate all applicants for employment, employees, applicants to serve as volunteers, and volunteers and any other person who is expected to be alone with one or more children enrolled in the child day center are to obtain the required central registry background checks.

Plan of Correction: Per administrator: We will locate the background check or call the central registry to get a copy and place in the staff's record.

Standard #: 63.2(17)-1716-A
Description: Based on the visual inspection of the facility and administrative records, the required written Code of Compliance Statements were not provided to parents. Evidence: During the visual inspection of the facility and review of administrative records, the following written Code of Compliance Statements were not provided or available to parents: 1. Written notice disclosure to parents or guardians that the center is religiously exempt from licensure. 2. Written notice to parents or guardians of staff qualifications.

Plan of Correction: Per administrator: I will have the statements for parents by the next week.

Standard #: 63.2(17)-1716-A-3
Description: Based on the visual inspection of classroom #1 and #2 the required ratios were not maintained.

Evidence:
During the inspection of classroom #1 (toddler room) it was observed that four-two year old children, one three year old child, and one four year old child were being supervised by one staff. Per updated regulations effective July 1, 2019, for each age grouping of children a minimum of one staff per age group is required based on the number of children in the group. The center was not in compliance with this regulation as two staff were not present.

Also in classroom #2 (school age), eight children (ages 5-9yrs) and five children (ages 9-12yrs) were discovered with one staff. Updated regulations that became effective July 1, 2019 requires one staff for every 20 children ages five years to nine years, and one staff member for every 25 children ages nine to twelve years. The center was not in compliance with this regulation as an additional staff was not present.

Plan of Correction: Per administrator: We will have additional staff in each classroom.

Description: Based on the inspection of administrative records, the required staff health report was not obtained and available to review. Evidence: During the inspection of two staff records, it was discovered that staff #1 did not have documentation of an annual staff health report in the record. Religious exempt requirements stipulate that each staff person in a supervisory position has been certified by a practicing physician or physician assistant to be free from any disability which would prevent him from caring for children under his supervision.

Plan of Correction: Per administrator: I will have the staff to obtain a staff health report as soon as possible.

Description: Based on the visual inspection of the facility and administrative records, the required written Code of Compliance Statements were not provided to parents. Evidence: During the visual inspection of the facility and review of administrative records, the following written Code of Compliance Statements were not provided or available to parents: 1. Written statement provided to parents or guardians and made available to the general public regarding physical facilities. 2. Written statement provided to parents or guardians and made available to the general public regarding enrollment capacity. 3. Written statement provided to parents or guardians and made available to the general public regarding food service. 4. Written statement provided to parents or guardians and made available to the general public regarding health requirements for staff. 5. Written statement provided to parents or guardians and made available to the general public regarding possession of liability insurance.

Plan of Correction: Per administrator: I will have the statements for parents by the next week.

Standard #: 63.2(17)-1716-B-3
Description: Based on the inspection of administrative records, there were no staff present that have been trained to conduct daily simple health screenings of children. Evidence: During the inspection of two staff records and interview with the administrator, it was discovered there were no staff that received training in daily health screenings. Religious exempt requirements stipulate that a staff should be able to conduct a daily simple health screening and exclusion of sick children by a person trained to perform such screenings.

Plan of Correction: Per administrator: I will have my lead staff to take the training either online or in a class setting.
