Comments:
An unannounced compliance monitoring inspection was conducted on August 7, 2019 from 8:50 a.m. to 10:45 a.m. An exit meeting was conducted from 1:15 p.m. to 2:30 p.m. with the director on August 12, 2019. 50 children, ages 2 years through 13 years old were in care. Center documents and ten staff records were reviewed. Please provide proof of corrective action for noncompliance and proof of background checks within 10 business days (8/26/2019). Standard #: 63.2(17)-1716-A-3
Description: Based on observation, the center failed to ensure staff to children ratio requirements. Evidence: 1. For each grouping of children, at least one adult staff member was not regularly present. There was one staff member with 32 children in the following age groups: 36 months to 5 years, 5 years to 9 years and 9 years to 12 years. 2. Staff members shall be at least 16 years of age. A 13 year old was observed providing supervision for a 2 year old child. The 13 year old was sitting at the front desk providing access to the secure building. 3. On 8/12/2019 there was one staff member supervising 17 children in the following age groups: 36 months to 5 years, 5 years to 9 years and 9 years to 12 years. 4. On 8/12/2019, a 13 year old child was observed in the 3 and 4 year old classroom with one staff member and 17 children.

Plan of Correction: All staff will be at least 16 years old. Each grouping of children will have an assigned staff member.

Description: Based on observation, the center failed to maintain the required ratio of one staff member to eight children from ages 24 months to 36 months. Evidence: 1. At approximately 8:50 a.m., a two year old child was observed in the front office area with a 13 year old child without sight and sound supervision from an adult. 2. The same two year old was observed in a classroom alone and walking the halls, leaving a classroom without supervision from staff. 3. There were nine children age 24 months through 36 months with one staff member.

Plan of Correction: All staff will be retrained about supervision and ratio. Additional staff will be assigned as needed.

Description: Based on observation, the center failed to maintain the required ratio of one staff member to ten children from ages 36 months to 5 years old. Evidence: 1. At approximately 8:55 a.m., there were 32 children ranging in age from 4 years through 13 years old combined in the front left classroom with one staff member. A staff member is required for each age group present. 2. The staff member assigned to the combined age group classroom was observed leaving the classroom and placing children out of sight and sound supervision. 3. Several children were observed leaving the classroom without supervision. 4. One four year old was observed unsupervised in the bathroom for approximately 15 minutes. 5. One four year old was in the hallway unsupervised. 6. On 8/12/2019, there were 17 children ages 3 and 4 years old with one staff member.

Plan of Correction: All children will be assigned to age appropriate group and an additional staff will be assigned at all times.

Description: Based on observation, the center failed to maintain the required ratio of one staff member to 20 children from ages 5 years to 9 years old. Evidence: 1. At approximately 8:55 a.m., there were 32 children ranging in age from 4 years through 13 years old combined in the front left classroom with one staff member. A staff member is required for each age group present. 2. The staff member assigned to the combined age group classroom was observed leaving the classroom and placing children out of sight and sound supervision. 3. Several children were observed leaving the classroom without supervision.

Plan of Correction: Staff will be retrained about supervision and all children will be assigned based on their age groups with the appropriate number of staff.

Description: Based on observation, the center failed to maintain the required ratio of one staff member to ten children from ages 9 years to 12 years old. Evidence: 1. At approximately 8:55 a.m., there were 32 children ranging in age from 4 years through 13 years old combined in the front left classroom with one staff member. A staff member is required for each age group present. 2. The staff member assigned to the combined age group classroom was observed leaving the classroom and placing children out of sight and sound supervision. 3. Several children were observed leaving the classroom without supervision. 4. At approximately 8:50 a.m, a 13 year old child was observed in the front office area alone with a two year old child at the beginning of the inspection. 5. A 10 year old child was observed in the multipurpose room alone. The child was without sight and sound supervision for approximately 10 minutes. 6. On 8/12/2019, there was one staff member with 17 children from 4 years through 10 years old.

Plan of Correction: Staff will be retrained on supervision requirements and each grouping of children will have a staff assigned.

Standard #: 63.2(17)-1716-A-4
Description: Based on a review of eight staff records, the center did not provide required annual documentary evidence that each person in a supervisory position has been certified by a practicing physician or physician assistant to be free from any disability which would prevent him from caring for children under his supervision. Evidence: Staff #1 and Staff #8 did not have documentation of an annual health statement in the record. Staff #3 most recent annual health statement was dated 5/4/2017, Staff #4 most recent annual health statement was dated 5/16/2017, Staff #5 most recent annual health statement was dated 5/10/2018, Staff #6 most recent annual health statement was dated 4/13/2017. Staff #7 most recent annual health statement was dated 3/28/2017.

Plan of Correction: The annual health reports have been misfiled and will be provided as soon as possible.

Standard #: 63.2(17)-1716-A-5-d
Description: Based on observation, the vehicle used to transport children did not have a valid inspection sticker. Evidence: The center van had a rejection sticker from July 2019.

Plan of Correction: The van was inspected on August 8, 2019.

Standard #: 63.2(17)-1716-B-2
Description: Based on review of documentation and observation, the center failed to follow center policies regarding appropriate supervision of all children in care. Evidence: In the staff handbook under "staff responsibilities" 1. All staff assigned responsibility for supervision of children shall ensure their care, protection and guidance at all times. 2. Children under 10 years of age shall be within actual sight and sound supervision of staff at all times... Children ages 2 years through 10 years were observed without sight and sound supervision of staff members.

Plan of Correction: This information will be included in the staff retraining that is going to be scheduled as soon possible.

Standard #: 63.2(17)-1716-B-3
Description: Based on a review of nine staff records and staff interview, the center failed to conduct daily simple health screenings and exclusion of sick children by a person trained to perform such screening. Evidence: There was no documentation that staff members are trained in daily health observation.

Plan of Correction: There will be a staff member on each shift trained in daily health screenings.

Standard #: 63.2(17)-1716-B-6
Description: Based on review of documentation and interview with staff, the was not an established policy to ensure all staff are able to recognize the signs of child abuse and neglect. Evidence: Of ten staff records, one staff had documentation of training in recognizing the signs of child abuse and neglect. There was no documentation of staff training or that staff are able to recognize the signs of child abuse and neglect for the other nine staff.

Plan of Correction: We will document that staff have been trained in the requirement.

Standard #: 63.2(17)-1720.1-A
Description: Based on review of ten staff records and an interview with the owner/director, it was determined that not all sworn statement or affirmation were repeated every five years as required. Evidence: The most recent sworn statement on file for Staff #2 was dated 10/1/2012 and for Staff #6 was dated 3/6/2009.

Plan of Correction: Staff #6 completed the sworn statement during the inspection. Staff #2 will update the sworn statement by tomorrow.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on review of documentation, the center failed to obtain fingerprint background checks by September 30, 2018 for existing staff. Evidence: Staff #1, start date 9/11/2015, did not have documentation of fingerprint background checks in the record.

Plan of Correction: Staff #1 has an appointment for the fingerprint background check today.
