22VAC40-191 Background Checks for Child Welfare Agencies 63.2(17) License & Registration Procedures

Comments:

An unannounced "Code of Virginia Section 63.2-1716" compliance monitoring inspection was conducted today from 9:30 a.m. to 12:10 p.m. 23 children, ages 4 years through 5 years old, were under the care and supervision of 4 staff. Center documents and 4 staff records were reviewed. Standard #:	22VAC40-191-40-D-2
Description:	Based on review of documentation and interview with staff, it was determined that the center did not obtain sworn statements prior to the 1st day of employment and central registry background check results by the 30th day of employment. Evidence: Staff A, hire date 01/20106; staff B, hire date 10/2015; staff C, hire date 8/2010; staff D, start date 9/2018 were missing completed sworn statement forms and central registry background checks.
Plan of Correction:	In the future, all background checks will be completed within the designated time frames.

Description:	Based on review of documentation and interview with the director, the center did not provide a written statement to the parents or guardians of the center and the general public regarding physical facilities, health requirements for staff, public liability insurance. Evidence: There was no written statement regarding physical facilities, health requirements for staff, public liability insurance.
Plan of Correction:	The center will create a written disclosure for the general public regarding physical facilities, health requirements for staff, and liability insurance.
Standard #:	63.2(17)-1716-B-3
Description:	Based on review of documentation and interview with staff, the center did not have have the required policy regarding daily simple health screening, exclusion of sick children by a person trained to perform such screenings. Evidence: No staff had documentation of Daily Health Observation Training.
Plan of Correction:	A daily health observation training will be scheduled as soon as possible.

Description:	Based on a review of documentation and staff interview, the center did not have a policy or procedure for ensuring that all areas of the premises accessible to children are free of obvious injury hazards, including providing and maintaining sand or other cushioning material under playground equipment. Evidence: There was no written policy to address obvious safety hazards and resilient surfacing under the playground equipment.
Plan of Correction:	The center will create a written policy regarding obvious safety hazards and maintaining the cushioning under the playground equipment.

Description:	Based on review of documentation and interview with staff, it was determined that the center did not obtain documentation of fingerprint background check results prior to employment. Evidence: Staff A, hire date 01/20106; staff B, hire date 10/2015; staff C, hire date 8/2010; staff D, start date 9/2018 did not have fingerprint background checks.
Plan of Correction:	In the future, all fingerprint background check results will be received prior to employment.
