Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Child Day Centers was conducted on November 12, from 11:30 a.m. to 2:15 p.m. At the time of arrival the following staff to child ratios were observed:
12 children, four to five years old, with 2 staff
12 children, four to five years old, with 2 staff
11 children, four to five years old, with 2 staff
Classroom observations were made and children were observed cleaning up from learning centers and eating a family style lunch which included several selections of each food group component from which children could to choose. Eighteen staff records were reviewed, posted information as well as information contained on the program's public web site were reviewed, and the center program administrator was interviewed regarding specific center policies and procedures. The facility, to include all areas used by children in care were observed.
Staff report that the program does not routinely transport children in a vehicle while in care. However, when scheduled field trips or outings are offered children are transported by a contracted transportation bus company and the bus is operated by a commercial driver.

Description: Based on a review of records and interview, the Religious Exempt program did not ensure that every staff, prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center except a parent-volunteer, or a parent or guardian who may be left alone with his or her own child has results of a Search of Central Registry on file within 30 days of employment or commencement of service.

Evidence:
Eighteen (all) staff records were reviewed during the inspection on 11/12/19.
The records for staff #12 (hired 9/16/19) and staff #16 (hired 7/1/15) did not contain results for a Search of the Central Registry. The Program Director confirmed that these staff were currently employed and that results of a Search of the Central Registry were not available at the time of inspection.

Plan of Correction: The following written response was received in the licensing office on 11/22/19:
"Staff #12 was mailed and returned and resubmitted. Staff #16 new CPS has been submitted. Awaiting return mail."

Standard #: 63.2(17)-1721.1-A
Description: Based on a review of records and interview, the Religious Exempt program did not ensure that every staff has current results of a Search of Central Registry on file within 5 years from the most recently documented results of a Central Registry Search.

Evidence:
Eighteen (all) staff records were reviewed during the inspection on 11/12/19.
The record for staff #3 (hired 3/1/17) contained the most current results of a Central Registry Search which were dated 8/23/06.
The record for staff #4 (hired 3/1/17) contained the most current results of a Central Registry Search which were dated 10/14/15.
The record for staff #5 (hired 3/1/17) contained the most current results of a Central Registry Search which were dated 9/5/06.
The records for staff #3, staff #4, and staff #5 did not contain updated results for a Search of the Central Registry, which were dated within 5 years from the last documented Search of the Central Registry.
The Program Director confirmed that these staff are currently employed and that more current results of a Search of the Central Registry were not available at the time of inspection.

Plan of Correction: The following written response was received in the licensing office on 11/22/19:
"Each staff has been notified and Central Registry Searches will be submitted."

Standard #: 63.2(17)-1721.1-B-2
Description: Based on a review of records and interview, the Religious Exempt program did not ensure that every staff, prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center except a parent-volunteer, or a parent or guardian who may be left alone with his or her own child has results of a Federal finger-print based criminal record check is on file prior to employment or commencement of service.

Evidence:
Eighteen (all) staff records were reviewed during the inspection on 11/12/19.

The records for staff #8 (hired 9/16/19) did not contain results for a Federal finger-print based criminal record check.

The records for staff #3 (hired 3/1/17), staff #4 (hired 3/1/17) and staff #6 (hired 8/3/18) contained results for a Federal finger-print based criminal record check.They did NOT, however, contain finger print results from the required agency (Office of Background Investigations / "OBI").

The Program Director confirmed that staff #3, #4, #6 and #8 are currently employed and that results of the required Federal finger-print based criminal record check obtained through "OBI" were not available at the time of inspection.

Plan of Correction: The following written response was received in the licensing office on 11/22/19:
"Each staff has been made aware of fingerprint status and are required to complete the process immediately.
At no time are staff members expected to be alone with students."
