Technical Assistance:
Today we discussed resilient surfacing under and around outdoor play equipment and what types of equipment requires cushioning (any equipment with moving parts or used for climbing, sliding swinging).

Comments:
A compliance inspection to monitor the requirements for Religiously Exempt Child Day Centers was conducted on January 29, 2020, from 11:30 a.m. to 1:40 p.m. At the time of arrival the following staff to child ratios were observed:
8 children, three years old, with 1 staff
9 children, three to four years old, with 1 staff
9 children, three to four years old, with 1 staff
10 children, four years old, with 1 staff
13 children, four years old, with 2 staff
Classroom observations were made and children were observed playing in free choice learning centers, eating lunch and creating art. Dismissal procedures were also observed.
Five staff records were reviewed, posted information and parent handbooks were reviewed and the center program director was interviewed regarding the centers policies and procedures. The facility, to include indoor areas used by children in care, as well as the outdoor play space, were observed.
The program director states that the program does not routinely transport children in a vehicle.
Unmet requirements were observed and are documented on the violation notice.

Violations:
Standard #: 63.2(17)-1716-A-6
Description: Based on a review of the posted and printed parent information and interview, the program did not make available to the parents and general public all required aspects of the exempt program.
Evidence:
The posted Statement of Intent in the entry way to the center did not include information about whether the center carries liability insurance coverage. When asked if this information is provided elsewhere for parents and general public, the program director checked the parent handbook and state that this information was not available in written format.

Plan of Correction: Staff #2 stated that information about the center's liability insurance would be added to the posted statement today.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on a review of records and interview, the religious exempt program failed to follow up on a request for any child abuse and neglect registry or equivalent registry maintained by any other state in which a staff has resided in the preceding five years.

Evidence:
The most recent sworn disclosure statement completed by Staff#5 indicated that the staff person resided outside of the state of Virginia in the last 5 years.
Staff #1 indicated on the Sworn Disclosure form that she resided in Connecticut and Maryland within the last 5 years.
There were no results from the State of Connecticut regarding a search of the child abuse and neglect registry for this staff.
The file for staff #1 contained a copy of a request for a search of the registry for Connecticut which was marked as faxed on 12/13/18. However, there was no documentation indicating that the program had followed up on the request after 45 days.

Plan of Correction: Staff #2, the new program director for the facility, stated that she would follow up on the request for the Connecticut Search of the Registry today and document the information from the call and continue to follow up as needed.
