Comments:
On January 28, 2020, the Department received a self-reported concern for an incident that occurred on November 27, 2019, regarding a child?s injury. The licensing inspector was on site conducting an unannounced subsidy inspection on February 5, 2020 from approximately 12:00 PM until 1:35 PM. While on site, interviews with staff were conducted, observations were made and documentation was reviewed. Based on the information gathered during the investigation, the preponderance of evidence supports violations of subsidy health and safety requirements.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and returned it to me within five business days from today. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Violations:
Standard #: 22VAC40-665-550-2
Description: Based on interviews, documentation review and observations, the vendor did not inform the department?s representative as soon as practicable, but not more than two business days, of any injury to a child while under the vendor?s supervision when a referral is made for treatment from a medical professional.

Evidence:

During the February 5, 2020 interviews and documentation review, the following was determined:

1. On November 27, 2019, staff stated Child #1 (2-years old) had her hand closed in the classroom door.

2. Staff stated 911 was called and Child #1 was transported to a nearby hospital.

3. On February 5, 2020, members of management confirmed they did not notify the department within two business days that Child #1 was seen by the doctor as a result of the November 27, 2019 incident. The center submitted an online serious injury report to the department on January 28, 2020 once they became aware of the reporting requirement.

Plan of Correction: We corrected our plan immediately after discovering that the online form for reporting injuries requiring medical attention said two days instead of one year which was stated in the e-mail that we received as a religious exempt center.

Now that we are aware of the requirement, we will post information for the commissioner's review within the two day limit if we have an injury that requires medical attention.

Standard #: 22VAC40-665-700-C
Description: Based on documentation review, the vendor did not maintain a written record of children?s serious and minor injuries containing all of the required information.
Evidence:
1. An accident report was dated as being completed on November 27, 2019, when Child #1 (2-years old) had her hand closed in the classroom door.
2. The accident report did not include staff and parent signatures or two staff signatures and the time the parents were notified of the injury.

Plan of Correction: We already had an incident/injury report form in place, which was signed by the director. The parents declined to sign our copy. We have corrected the procedure so that we have two staff members sign in addition to the parent if they are willing to sign. The teacher in charge of the room fills out the report, the director (or person in charge in her absence) reviews and signs on all injuries, the parent is given one copy and asked to sign a copy for our files. A copy of our report is included.
