Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A code compliance inspection was initiated on 02/10/2021 and concluded on 02/10/2021. The director was contacted by telephone to initiate the inspection. There were 6 children present and 2 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 2 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review, the center did not ensure one of two staff records had documentation of a completed sworn statement or affirmation prior to the first day of employment.
Evidence:
The record of staff #1 (start date: 1/4/2021) had documentation of a completed sworn statement or affirmation dated 1/5/2021.

Plan of Correction: Notation added to new employee policy to reflect that Sworn Statement be signed prior to beginning employment, even when not working alone or unsupervised with the children.

Standard #: 63.2(17)-1720.1-B-2
Description: Based on record review, the center did not ensure one of two staff records contained documentation of fingerprint based national criminal history search results prior to employment.
Evidence:
1. The record of staff #1 (start date: 1/4/21) had documentation of fingerprint based national criminal history search results dated 1/13/21.

Plan of Correction: After discussion with VDSS of the exact procedures and clarification of the out of state records request process that took effect on 1 July 2020, we updated policy and procedures to reflect the following:

Notation added to new employee policy to reflect that fingerprint results to be received prior to beginning employment, even when not working alone or unsupervised with the children.

Standard #: 63.2(17)-1720.1-B-3
Description: Based on record review and interview, the center did not ensure one of two staff records contained documentation of out of state child abuse and neglect search request by the end of the 30th day of employment.
Evidence:
1. The record of staff #1 (start date: 1/4/21) did not have documentation of an out of state child abuse and neglect search request.
2. The Sworn Statement or Affirmation of staff #1 indicated that the staff has lived in two other states within the past five years.
3. The center representative stated that child abuse and neglect search was not obtained from the perspective states but rather from staff #1?s previous employer.

Plan of Correction: After discussion with VDSS of the exact procedures and clarification of the out of state records request process that took effect on 1 July 2020, we updated policy and procedures to reflect the following:

All records for day care staff transferring in from out of state will submit to our requesting Out of State Abuse and Neglect Search and Offender search directly from the state VDSS and governmental websites in the states that they resided in over the past 5 years- not from their previous daycare facility that they transferred in from as we had previously requested them.

It will also be noted that VDSS clarified that the approved transferred in background checks/fingerprints/ security records from an out of state facility can not be used to begin while waiting for the requested Virginia records, even when the staff is working in conjunction with/under the supervision of other approved day care staff and had been previously employed in our day care now that VDSS clarified the process.

Description: Based on record review and interview, the center did not ensure one of two staff records contained documentation of criminal history record results and a sex offender registry check results from any state in which the individual has resided in the past five years.

Evidence:
1. The record of staff #1 (start date: 1/4/2021) did not have documentation of criminal history record results and a sex offender registry check results from any state in which the individual has resided in the past five years.
2. The Sworn Statement or Affirmation of staff #1 indicated that the staff has lived in two other states within the past five years.
3. The center representative stated that criminal history record results and a sex offender registry check results were not obtained from the perspective states but rather from staff #1?s previous employer.

Plan of Correction: After discussion with VDSS of the exact procedures and clarification of the out of state records request process that took effect on 1 July 2020, we updated policy and procedures to reflect the following:

All records for day care staff transferring in from out of state will have their background checks and records sent in directly from the state VDSS that they resided in over the past 5 years- not from their previous daycare facility that they transferred in from as we had previously requested them.

It will also be noted that VDSS clarified that the approved transferred in background checks and records of fingerprints from an out of state facility can not be used to begin while waiting for the requested Virginia records, even when the staff is working in conjunction with/under the supervision of other approved day care staff and had been previously employed in our day care now that VDSS clarified the process.
