22VAC40-665 INTRODUCTION

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A code compliance inspection was initiated on 03/04/2021 and concluded on 03/04/2021. The director was contacted virtually to initiate the inspection. There were 71 children present and 16 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 22 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on staff record review, the center did not ensure fifteen of twenty three staff records had documentation of central registry results within 30 days of employment and / or a completed sworn statement or affirmation prior to employment.
Evidence:
1. The record of staff #1 (start date: 2/1/21) had documentation of a completed sworn statement of affirmation dated 2/7/21
2. The record of staff #6 (start date: 2/3/20) did not have documentation of central registry results.
3. The record of staff #7 (start date: 9/18/20) did not have documentation of central registry results and documentation of a completed sworn statement of affirmation dated 9/19/20.
4. The record of staff #8 (start date: 12/30/20) did not have documentation of central registry results.
5. The record of staff #9 (start date: 12/30/19) did not have documentation of central registry results.
6. The record of staff #10 (start date: 9/11/20) did not have documentation of central registry results.
7. The record of staff #11 (start date: 9/16/20) did not have documentation of central registry results.
8. The record of staff #12 (start date: 11/2/20) had documentation of central registry results dated 12/4/20 and documentation of a completed sworn statement of affirmation dated 11/4/20.
9. The record of staff #16 (start date: 10/7/20) had documentation of central registry results dated 11/10/20.
10. The record of staff #17 (start date: 8/13/20) had documentation of a completed sworn statement of affirmation dated 9/15/20.
11. The record of staff #18 (start date: 11/20/20) had documentation of a completed sworn statement of affirmation dated 11/22/20.
12. The record of staff #20 (start date: 8/31/20) had documentation of a completed sworn statement of affirmation dated 9/15/20.
13. The record of staff #21 (start date: 12/14/20) had documentation of central registry results dated 1/28/21.
14. The record of staff #22 (start date: 9/11/20) had documentation of a completed sworn statement or affirmation dated 9/21/20.
15. The record of staff #23 (start date: 1/28/21) did not have documentation of central registry results.

Plan of Correction: Director has installed procedures to ensure the sworn statement of affirmation is signed when fingerprint instructions are given to the potential employer which is prior to start date. Central registry forms are currently sent in within the first week of employment, however the director has altered this requirement to occur on or before the employee?s start date. On 3.4.2021 the director contacted the Office of Background Investigations (OBI). Five of the missing central registries forms were located within the OBI office and provided to the center. The director has reached out to TCCC finance for the check number for the remaining two missing forms to aid the OBI in locating. The director has also resubmitted new submissions for these missing forms along with new payment on 3.8.2021 so a new search may be conducted.The director will follow up in email with the central registry office on 4.1.2021 if results have not been returned. A large calendar and a cover sheet spreadsheet for the employee's file will be used to track new employee key dates.

Description: Based on record review and interview, the center did not ensure three of twenty-three staff records contained documentation of criminal history record results prior to hire, sex offender registry check results prior to hire and child abuse and neglect search request within 30 days of employment from any state in which the individual has resided in the past five years.

Evidence:
1. The record of staff #5 (start date: 9/8/2020) did not have documentation of criminal history record results, sex offender registry check results and child abuse and neglect search request from any state in which the individual has resided in the past five years.
2. The record of staff #13 (start date: 1/28/2021) did not have documentation of criminal history record results, sex offender registry check results and child abuse and neglect search request from any state in which the individual has resided in the past five years.
3. The record of staff #21 (start date: 12/14/2020) did not have documentation of criminal history record results, sex offender registry check results and child abuse and neglect search request from any state in which the individual has resided in the past five years.

Plan of Correction: Director will conduct the needed background checks for all states not in Virginia for Staff #5. In the future, background checks will be completed for all states lived in within 5 years. Sworn statements answering the question affirmative to the question regarding out of state addresses will be noted by Director. A large calendar and the cover sheet spreadsheet for the employee's file will be used to track new employee states and key dates. Director will conduct the needed background checks for all states not in Virginia for Staff #13. In the future, background checks will be completed for all states lived in within 5 years. Sworn statements answering the question affirmative to the question regarding out of state addresses will be noted by Director. A large calendar and the cover sheet spreadsheet for the employee's file will be used to track new employee states and key dates.
