22VAC40-191 Background Checks for Child Welfare Agencies

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.
A virtual code compliance inspection was conducted on March 17, 2021. The director was contacted by telephone to initiate the inspection. There were no children in care. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed two staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the facility.

Standard #: 22VAC40-191-40-D-2 Description: Based on record review, in one of two staff records reviewed, the centter did not conduct a search of the central registry and obtain results within 30 days of employment.
Evidence: The Director confirmed that there was no documentation of results of a search of the central registry for Staff #1 who has been employed for more than 30 days at the center.Plan of Correction: I will have the employee to complete the paperwork and mail it to the Office of Background Investigations.
Standard #: 63.2(17)-1720.1-B-4 Description: Based on record review, in one of two staff records reviewed, the center did not obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence: The Director confirmed that they had not contacted or obtained required out of state background checks for Staff #1 who indicated as to residing outside of the state of Virginia within the past five years on the sworn statement.Plan of Correction: I will do the sex offender check today. I will contact the employee and make sure to complete the out of state background check.
