22VAC40-191 Background Checks for Child Welfare Agencies

An unannounced code compliance inspection was initiated on 3/18/21 and concluded on 3/24/21. The person in-charge was contacted by telephone to initiate the inspection. There were 27 children present and 5 staff. The inspector emailed the provider a list of items required to complete the inspection. The Inspector reviewed 2 staff records submitted by the facility to ensure documentation was complete.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #: 22VAC40-191-40-D-2 Description: Based on record review and interview, the center failed to have a completed central registry record check by the end of the 30th day of employment.
Evidence:
1. The director advised the date of hire for staff 1 was 7/30/20. The central registry record check is dated 10/15/20.
2. The director advised the date of hire for staff 2 was 5/19/20. The central registry record check is dated 11/5/20.
3. The director stated they were having trouble getting central registry results back but have no documentation of when the background checks were first mailed and followed-up.Plan of Correction: In the future the director will ensure central registry paperwork is completed and mailed upon hire. If no response in received within 30 days the director will follow-up and document the staff file.
Standard #: 63.2(17)-1716-B-6 Description: Based on record review and interview, the center failed to establish and implement a procedure to ensure that all staff are able to recognize the signs of child abuse and neglect.
Evidence:
1. The director stated the date of hire for staff 1 was 7/30/20. The documentation provided for staff 1's child abuse and neglect training is dated 3/18/21.
2. The director stated she did have some child abuse and neglect training as part of another training on 2/18/21 but the center did not require staff 1 to complete child abuse and neglect training prior to that.Plan of Correction: In the future the center has established a procedure to ensure all new staff complete child abuse and neglect training upon hire and prior to working with children.
Standard #: 63.2(17)-1720.1-B-2 Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.
Evidence:
1. The director advised staff 1's date of hire was 7/30/20. The fingerprint-based criminal history check determination letter for staff 1 is dated 8/4/20.
2. The director stated during the time this staff was hired it was taking weeks to get fingerprints completed and staff were needed.Plan of Correction: In the future no staff will be hired until the fingerprint-based criminal history check determination letter is obtained.
