Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia A compliance inspection was initiated on 5/18/21 and concluded on 5/21/21. The director was contacted by telephone to initiate the inspection. There were 50 children present and 13 staff. The inspector emailed the director/provider a list of items required to complete the inspection. The Inspector reviewed 25 staff records submitted by the facility to ensure documentation was complete. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility. The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 63.2(17)-1720.1-B-4
Description: Based on a review of 25 staff records, it was determined that the provider did not ensure that the center obtain a copy of the results of a criminal history record information check, a completed search of the central registry, and a completed sex offender registry check from any state in which the applicant has resided in the preceding five years.

Evidence:
1. The record for staff #10 (date of hire 5/7/21) did not contain documentation of a completed criminal history record information check and sex offender registry check from the state of Washington. The sworn statement or affirmation located in the record for staff #10 indicated that staff #10 lived in the state of Washington within the last 5 years.
2. The record for staff #19 (date of hire 12/2/20) did not contain documentation of a completed search of the central registry from the state of Maryland and Washington D.C.. The sworn statement or affirmation located in the record for staff #19 indicated that staff #19 lived in the state of Maryland and Washington D.C. within the last 5 years.
3. The record for staff #24 (date of hire 11/25/19) did not contain documentation of a completed search of the central registry check from the state of Hawaii. The sworn statement or affirmation located in the record for staff #24 indicated that staff #24 lived in the state of Hawaii within the last 5 years.
4. Staff #13 (Program Administrator) reviewed the records for the staff #10, staff #19, and staff #24, and confirmed that the required out-of-state background checks were not received for each staff.

Plan of Correction: The provider responded: We have already requested the required out-of-state background checks for each staff and forward the results to the Licensing Inspector when received. All new employees that have lived outside the state of Virginia will not start until the criminal history record information check and sex offender registry check from the state they previously resided in has been received. In addition, we will ensure that a completed search of the central registry is received for each staff within 45 days of employment.
