Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A code compliance inspection was initiated on 06/08/2021 and concluded on 06/08/2021. The director was contacted via video call to initiate the inspection. There were 32 children present and 5 staff. The inspector emailed the director a list of items required to complete the inspection. The Inspector reviewed 6 staff records submitted by the facility to ensure documentation was complete.
Information gathered during the inspection determined non-compliances with applicable code sections and violations were documented on the violation notice issued to the facility.
The Licensing Inspector has reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on staff record review, the center did not ensure four of six staff records had documentation of central registry results within 30 days of employment and a completed sworn statement or affirmation prior to employment.
Evidence:
1. The record of staff #1 (start date: 6/16/20) did not have documentation of central registry results.
2. The record of staff #2 (start date: 9/02/20) did not have documentation of central registry results.
3. The record of staff #3 (start date: 6/1/20) did not have documentation of central registry results and a completed sworn statement or affirmation dated 12/1/21.
4. The record of staff #5 (start date: 12/7/20) did not have documentation of central registry results.

Plan of Correction: Staff #1, Staff #2 and Staff #3 have completed central registry search and they are awaiting results. Staff #5 is completing central registry search and it will be completed by 6/25/2021.

Description: Based on staff record review, the center did not ensure each staff person had a Heath Report certified by a practicing physician indicating the staff to be free of any disability which would prevent him from caring for children under his supervision.
Evidence:
Staff #5 (start date: 12/7/2020) did not have a Health Report.

Plan of Correction: Staff is in process of returning completed staff health report. We expect to receive this document by 6/25/2021.

Description: Based on staff record review, the center did not ensure one of six staff records had documentation of fingerprint based national criminal history search results prior to employment.
Evidence:
1. The record of staff #3 (start date: 6/1/20) had documentation of fingerprint based national criminal history search results dated 12/4/20.

Plan of Correction: Staff member will have updated fingerprint check completed by 6/17/2021 pending results.
Center Administrators will ensure that each staff member has a completed and valid finger print check on file before beginning work at the center.

Description: Based on record review, the center did not ensure two of six staff records contained documentation of criminal history record results, sex offender registry check results and a child abuse and neglect search request from any state in which the individual has resided in the past five years.

Evidence:
1. The record of staff #1 (start date: 6/16/2020) did not have documentation of criminal history record results, sex offender registry check results and a child abuse and neglect search request from any state in which the individual has resided in the past five years.
2. The record of staff #3 (start date: 6/1/2020) did not have documentation of criminal history record results, sex offender registry check results and a child abuse and neglect search request from any state in which the individual has resided in the past five years.
3. The Sworn Statement or Affirmation for staff #1 and staff #3 indicated that each staff has lived in one other state within the past five years.

Plan of Correction: Staff [#1] has completed and received an out of state Abuse and Neglect report for the State of Delaware and an out of state Sex Offender Registry search for the state of Delaware.
Awaiting return of the criminal out of state background check for the state of Delaware.
Center Administrators will ensure that each staff member has a completed and out of state background checks if they have lived in another state in the past 5 years.
