Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documentation review, interviews and a virtual tour of the program.

A code compliance inspection was initiated on 10/21/21 and concluded on 10/27/21. The director/in-charge person was contacted by telephone and a virtual inspection was conducted. There were 15 children present, ranging in ages from two to six, with four staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and medication. A total of two children?s records and three staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22VAC40-191-40-D-2
Description: Based on record review and interview, the center failed to have completed central registry record check by the end of the 30th day of employment.

Evidence:

1. Staff 1 and staff 3's hire date, per the director, was 2/1/21.
2. Staff 1's central registry finding is dated 9/2/21.
5. Staff 3's record did not contain the finding of a central registry background check.

Plan of Correction: Staff 3 will be required to complete the paperwork for a central registry background check which will be mailed by next week.
In the future paperwork for central registration will be mailed upon hire.

Description: Based on record review and interview, the center failed to ensure a person trained and certified in first aid will be present at the child day center whenever children are present.

Evidence:

The director stated no staff is certified in first aid.

Plan of Correction: A staff member will be trained in first aid as soon as a class can be scheduled.

Description: Based on record review and interview, the center failed to establish and implement a procedure in which a daily health screening and exclusion of sick children by a person trained to perform such a screening is conducted daily.

Evidence:

The director stated there is no staff in the center that is trained in daily health screening.

Plan of Correction: At least one staff member will be trained in daily health screening as soon as a class can be scheduled.

Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment.

Evidence:

1. Staff 1's start date, per the director, was 9/7/21.
2. There is no fingerprint background check for staff 1.

Plan of Correction: Staff 1 will be required to obtain a fingerprint background check.
In the future the director will ensure fingerprint results are obtained prior to hire.
