Technical Assistance:
Recommend the center to review the Subsidy requirements.

Comments:
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documentation review, interviews and a virtual tour of the program.
A monitoring inspection was initiated on 10/13/2021 . A self-reported incident was received by the department regarding allegations in the areas of Physical plant, Special care provision and emergencies and Staffing and supervision. The in-charge person was contacted by telephone to conduct
the virtual investigation.

The evidence gathered during the investigation supported the self-report of
non-compliance with standards or law and violations were issued. Any violations not related to the self-report but identified during the course of the investigation can be found on the violation notice.

Violations:
Standard #: 22VAC40-665-550-2
Description: Based on staff interview, the vendor did not inform the department's representative as soon as practicable, but not more than two business days, of any injury to a child while under the vendor's supervision when a referral is made for treatment from a medical professional.

Evidence: Staff#1 contacted the licensing inspector on October 13, 2021 of a incident that occurred on August 27, 2021. Child #1 sprayed pepper spray in his face . The center called 911 for medical assistance. The center flushed his eyes with water . Staff #1 stated in incident report that EMT confirmed they were providing appropriate care . The EMT recommended that a fan is aimed at Child #1 face. Staff #1 stated no other medical treatment was provided.

Plan of Correction: The EMT confirmed we were providing appropriate care.

The center director stated it was told by Child Protective Service he would be contacting licensing.

Child #1 was not transported for care and neither parent restructured the day to pick up early. The child took a nap after the incident. And he returned to the center on Monday.

In the future we will notify the licensing inspector the next business day or report on the link for outside medical treatment.

Standard #: 22VAC40-665-620-A
Description: Based on staff interview, the vendor did not ensure that hazardous substances shall be kept in a locked place using a safe locking method that prevents access by children.

Evidence: Staff #2 had a carabiner attached to a lunchbox with keys and pepper spray. Child #1 sprayed himself with pepper spray. Staff #1 and Staff #2 confirmed the pepper spray was not kept in a locked place.

Plan of Correction: All staff members personal belonging that contain lighter, medication or any hazardous material will be kept in a locked cabinet. Spoke to all staff immediately after incident happen individually on August 30, 2021 and August 31, 2021 and during a all staff meeting on September 14, 2021.

In the New employee Orientation we address the storing of hazardous material including personal belongings.

Standard #: 22VAC40-665-700-C
Description: Based on staff interview, the vendor did not have written record of children's serious and minor injuries in which entries are made the day of occurrence.

Evidence: Staff #1 stated an incident report was not completed on August 27, 2021 in regards to child #1 spraying himself with pepper spray.

Plan of Correction: Information was relayed immediate after contacting 911. We contact the parent . And we spoke in detail with the parent. When parent picked up we had a conversation with parent and child.

We will document the incident the day it occurs.
