Technical Assistance:
Today we discussed the timing of background checks for new employees:
A Sworn Statement of Affirmation form should be completed and signed prior to the first day of employment.

The results of a Criminal Record Check (fingerprints) must be obtained PRIOR to the hiring of a new staff. No training, orientation, etc. should be allowed until results are obtained.

A Search of the Central Registry must be requested (and documented) within 10 days of hire and the results must be obtained by the 30th day of employment. It is incumbent upon you to track the receipt of results, contact the agency if they are not received back before 30 days, and document the exchange / follow up until receipt of results.

PLEASE SEND TO YOUR INSPECTOR PROOF THAT YOU HAVE REQUESTED A SEARCH OF THE CENTRAL REGISTRY FOR STAFF #5 WITHIN 10 DAYS.
THE RESULTS OF THE SEARCH OF THE CENTRAL REGISTRY FOR STAFF #5 TO YOUR INSPECTOR UPON RECEIPT.

Comments:
A monitoring inspection was initiated and concluded on 7/19/2022. There were 52 children present, ranging in ages from infant to 11 years old, with 11 staff supervising. The inspector reviewed compliance in the areas of Religious Exempt Code Requirements; Background Checks Code; Carbon Monoxide Detectors; Report Of Abuse or Neglect, MAT Certification, Child abuse and neglect.
A total of 5 staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 8VAC20-770-40-D-2
Description: Based on a review of records, the religious exempt program did not ensure that each employee has the results of a Search of the Central Registry within 30 days of employment.

Evidence:
Five staff records were reviewed.
The record for staff #5, whose date of employment was documented as 5/2/2022, did not contain the results of a Search of the Central Registry.
There was not any documentation available at the time of the inspection showing that the request had been mailed out.

Plan of Correction: The Program Director (PD) will contact the department to see if a request for staff #5's central registry search was received by them and/ or processed. If so, then a copy of the results will be requested and placed in staff #5's record.
The PD had staff #5 complete a new request for the central registry search and if the results are not available from the department, a new request will be sent out today.
A copy of the form requesting that a Central Registry Search has been requested will be placed in the staff record and if results are not received within 30 days, the department will be contacted and documented to include any additional steps being taken to obtain them.
