Technical Assistance:
Training of staff regarding recognizing and reporting child abuse and neglect was discussed with the program director.

Comments:
A code compliance inspection was conducted on 8/18/2022. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of 20 staff records were reviewed.

Information gathered during the inspection determined non-compliance with applicable requirements or law and violations were documented on the violation notice issued to the program. Violations were discussed with the program director during the exit interview.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based upon review of 20 staff records, the facility has not ensured that staff have been certified by a practicing physician or physician assistant to be free from any disability that would prevent the staff from caring for children.
Evidence:
The records provided for staff 4, 5, 6, 11, 15, 16 and 17 did not have physician certification to be free of disability that would prevent them from caring for children.

Plan of Correction: The facility responded with the following:
All staff will be required to have a physician's statement prior to the end of September.

Standard #: 22.1-289.035-B-4
Description: Based upon review of staff records and staff interview, the facility has not ensured that they have obtained a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence:
1. The record provided for staff 2 indicated residence in South Carolina within the past five years. Results of a criminal record check from South Carolina were not obtained.
2. The record provided for staff 20 indicated residence in both Oregon and California within the past five years. Results of criminal record checks and child protective central registry searches were not obtained from either state.
3. The program director acknowledged that complete out of state background checks were not obtained as listed above.

Plan of Correction: The facility responded with the following:
Out of state criminal record checks, central registry searches and sex offender registry checks will be obtained for all staff who have lived in a state other than Virginia within the past five years. In the future, these results will be obtained prior to hire of new staff.

Standard #: 8VAC20-770-40-D-2
Description: Based upon review of 20 staff records and staff interview, the facility has not ensured that the results of child protective services (CPS) central registry search is obtained within 30 days of employment.
Evidence:
1. The record for staff 4 indicates a hire date of 2/11/2022. Results of a CPS central registry search had not been obtained.
2. The record for staff 9 indicates a hire date of 4/19/2022. Results of a CPS central registry search had not been obtained.
3. The record for staff 16 indicates a hire date of 8/31/2021. Results of a CPS central registry search had not been obtained.
4. The record for staff 18 indicates a hire date of 6/22/2022. Results of a CPS central registry search had not been obtained.
5. The program director acknowledged that the above records did not contain results of a CPS central registry search.

Plan of Correction: The facility responded with the following:
Child protective services central registry searches will be immediately requested for those staff without the results.
In the future, central registry searches will be requested within 7 days of employ and, if the results are not received within 30 days, the office of background investigations will be contacted to inquire.
