The center must establish and implement a procedure ensuring all staff can recognize signs of child abuse and neglect.
The center must post the exemption in a visible location to parents.
A copy of the Interstate Child Care Background Check Contact List was provided to the director to assist with completing out of state background checks.

An unannounced code compliance inspection was initiated on 9/13/2022 and concluded on 9/22/2022 from 9:40 AM to 10:45 AM. There were six children present, ranging in ages from three to five, with one staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision and procedures. A total of three children?s records and four staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #: 22.1-289.035-B-4 Description: Based on record review and interview, the center failed to obtain criminal record check before the first day of employment and a search of child abuse and a search of child abuse and neglect registry or equivalent registry maintained by any other state in which a new staff has resided in the preceding five years for any founded complaint of child abuse or neglect against him/her prior to the first day of employment.
Evidence:
1. The sworn statement for staff 1 documented staff 1 lived in Illinois within the last five years. The record for staff 1 did not contain a criminal background check for staff 1 nor a child abuse and neglect search for Illinois.
2. The director stated staff 1 has been working at the center since 4/22 and a criminal background check and central registry search has not been completed for Illinois.Plan of Correction: A criminal background check an search of central registry will be sent for staff 1 in Illinois by 10/3/22 and copies will be forwarded to the licensing inspector. When the results are received they will be forwarded to the inspector. In the future new staff that have lived outside the state of VA within the last five years will have background checks completed as required.
