8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

A subsidy health and safety inspection was initiated on 10/6/22 and concluded on 10/6/22. There were 20 children present, ranging in ages from two to five, with three staff. The Inspector reviewed three child?s records and three staff?s records. The physical plant was observed and the provider was interviewed regarding policies and procedures.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #: 8VAC20-790-550-2-a Description: Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to hire.
Evidence:
1. Staff 1's hire date was 2/24/21. The fingerprint-based criminal history check determination letters was dated 3/5/21.
2. Staff 2's hire date was 7/27/21. The fingerprint-based criminal history check determination letters was dated 8/2/21.
3. Staff 1's hire date was 6/30/21. The fingerprint-based criminal history check determination letters was dated 7/1/21.
4. The director stated she thought the requirement was they could not start working until the fingerprint-based criminal history check determination letters was received. None of the three staff started working until the letter was received.Plan of Correction: In the future no staff will be hired until the fingerprint-based criminal history check determination letters is received.
Standard #: 8VAC20-790-760-B-3 Description: Based on observation, the center failed to ensure the diapering area contained a nonabsorbent surface for diapering.
Evidence:
The changing pad used to change diapers in the 2's classroom was torn exposing the absorbent surface.Plan of Correction: The changing pad will be replaced. Staff will be advised to inform administration if changing pads become torn in the future.
