8VAC20-790 Subsidy Regulations

Comments:

The licensing inspector conducted an unannounced Subsidy Health and Safety inspection on October 4, 2022 from approximately 10:30am until 12:00pm. There were 13 children in attendance and a total of two staff members supervising. See Violation Notice for additional details. A total of five children?s files and two staff files were reviewed. A code compliance inspection was conducted on the same date as the SHSI supplemental inspection. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program. Standard #:	8VAC20-790-580-A
Description:	Based on review of five children's records, the vendor did not obtain documentation that each child had received the immunizations required by the State Board of Health before attending the center. Evidence: 1. The record for Child #1 (first date of attendance 10/15/2020) contained an immunization record dated 10/27/2020. 2. The record for Child #3 (first date of attendance 09/07/2021) contained an immunization record dated 09/17/2021. 3. The record for Child #5 (first date of attendance 01/19/2022) contained an immunization record dated 01/19/2022.
Plan of Correction:	We will ensure families submit copies of immunization records prior to children attending in the center going forward
Standard #:	8VAC20-790-600-B
Description:	Based on review of five children's records and interview, the vendor did not ensure within the first 90 days of employment one staff who worked directly with children completed Virginia Preservice Training for Child Care Staff. Evidence: The record for Staff #1 (Date of Employment 12/10/2020) did not contain documentation of completing Virginia Preservice Training for Child Care Staff. Staff #2 stated Staff #1 had not completed the training as of 10/04/2022.
Plan of Correction:	The staff member is working on the required training and I will ensure she finishes it.
Standard #:	8VAC20-790-600-I
Description:	Based on review of two staff records and interview, the vendor did not ensure at least one staff was on duty who had obtained within the last three years instruction in performing a daily health observation of children. Evidence: The records for the two staff members did not contain documentation of daily health observation training. Staff #2 stated neither of the staff members had completed the required training.
Plan of Correction:	I will take the free Daily Health Observation training offered by the department.
Standard #:	8VAC20-790-640-A
Description:	Based on observation, the vendor did not ensure all hazardous substances such as cleaning materials, insecticides, and pesticides were kept in a locked place using a safe locking method that prevented access by children. Evidence: 1. A can of sanitizing wipes were sitting on a shelf approximately three feet tall in the classroom where the 13 children were playing.
Plan of Correction:	The cleaning chemicals were moved to a locked location during the inspection.
Standard #:	8VAC20-790-670-C-6
Description:	Based on observation and documentation reviews, the vendor did not ensure when a group of children receiving care includes children from different age brackets, the age of the youngest child in the group was used to determine the staff-to-children ratio that applies to that group. Evidence: The licensing inspector observed 13 children in care in one classroom. The record for Child #5 indicated the child was 15 months old. Child #5 was present in the classroom and part of the 13 children receiving care on 10/04/2022. The required staff-to-child was one staff person for every four children present.
Plan of Correction:	We usually have another employee but that person was not able to work today.
