Comments:
The Licensing Inspector conducted an unannounced Subsidy Health and Safety inspection (SHSI) on Tuesday, October 18, 2022 from approximately 9:40am to 11:30am. There were 11 children in attendance and a total of three staff directly supervising. Upon arrival, the children were observed in their designated classrooms. The children were participating in a variety of activities. Staff were observed having positive interactions with the children. All areas of the facility including classrooms, kitchen, hallways, outdoor play area, and bathrooms were inspected. Five children's records and four staff records were reviewed.

A code compliance inspection was conducted on the same date as the SHSI supplemental inspection. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the
program.

Violations:
Standard #: 8VAC20-790-550-2-a
Description: Based on a review of four staff records and interview, the vendor did not ensure one staff had the satisfactory results of the fingerprint-based national criminal background check within the required timeframe.

Evidence: 1) The fingerprint-based national criminal background check in the record of Staff #3, employed 07/12/22, was completed on 09/19/18. 2) During interview, management reported Staff #3 was separated from employment and rehired. The center should have obtained a new fingerprint-based national criminal background check at the time of employment.

Plan of Correction: A new fingerprint-based background check will be obtained for Staff #3.

Standard #: 8VAC20-790-550-2-f
Description: Based on a review of four staff records and interview, the vendor did not obtain documentation of subsequent background checks conducted every five years one staff member.

Evidence: 1) The Virginia Child Protective Services Central Registry check in the record of Staff #4, employed 08/01/2007, expired on 10/10/2022. 2) During interview, management reported the central registry check for Staff #4 was not completed every five years as required.

Plan of Correction: The center will submit a new central registry check for Staff #4. Background checks will be repeated every five years as required.

Standard #: 8VAC20-790-560-A
Description: Based on a review of four staff records, the vendor did not ensure two staff were evaluated by a health professional and were issued a statement that the individuals were determined to be free of communicable tuberculosis (TB) within the required timeframe.

Evidence: 1) The TB screening in the record of Staff #1, employed 03/09/2022, was dated 02/04/2022. 2) The TB screening in the record of Staff #3, employed 07/19/22, was dated 05/25/22.

Documentation of the screening should be submitted at the time of employment and prior to coming into contact with children. The documentation should have been completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department.

Plan of Correction: In the future, TB screenings will not be more than 30 days old.

Standard #: 8VAC20-790-560-B
Description: Based on a review of four staff records and interview, the vendor did not ensure one staff had a subsequent tuberculosis (TB) screening at least every tow years from the date of the initial screening.

Evidence: 1) The most recent TB screening in the record of Staff #4 was dated 09/02/17. The TB should have been repeated no later than 09/02/19. 2) During interview, management reported a new TB screening was completed, but there is no documentation at the center.

Plan of Correction: A repeat TB will be request. Moving forward, staff will complete a repeat TB every 2 years as required.
