Comments:
An unannounced code compliance inspection was initiated on 10/24/2022 and concluded on 10/24/2022 from 1:50 PM until 2:45 PM. There were 23 children present, ranging in ages from three to five, with four staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of four children?s records and four staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility. The previous violation was reviewed for current compliance and a repeat violation was found.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based on record review and interview, the center failed to ensure each staff member has been certified by a physician, physician assistant, or nurse practitioner to be free from any disability which would prevent him from caring for children under his/her supervision for three out of four staff records reviewed.

Evidence:

1. The record for staff 2, start date 8/15/22, did not contain a staff health report.
2. The record for staff 3, start date 8/22/22, did not contain a staff health report
3. The record for staff 4, start date 7/18/22, did not contain a staff health report
4. The director stated they are working on getting the staff health reports for the three staff.

Plan of Correction: Staff 2, staff 3 and staff 4 will obtain staff health reports as soon as an appointment is obtained. In the future staff will be required to provide a staff health report before working with children.

Standard #: 22.1-289.035-B-2
Description: * Based on record review and interview, the center failed to obtain fingerprint-based criminal history check determination letters prior to the first day of employment for three out of four staff records reviewed.

Evidence:

1. The record for staff 2, hire date 7/1/22, has a fingerprint-based criminal history check determination letter dated 8/19/22.
2. The record for staff 3, hire date 8/8/22, has a fingerprint-based criminal history check determination letter dated 8/22/22.
3. The record for staff 4, hire date 7/8/22, has a fingerprint-based criminal history check determination letter dated 11/1/22.

Plan of Correction: In the future staff will not be hired until the fingerprint results are received.

Standard #: 22.1-289.035-B-4
Description: * Based on record review and interview, the center failed to obtain criminal record check and sex offender registry search before the first day of employment and a search of child abuse and neglect registry or equivalent registry maintained by any other state in which a new staff has resided in the preceding five years for any founded complaint of child abuse or neglect against him/her prior to the first day of employment.

Evidence:

The director stated staff 2, hire date 7/1/22, lived outside the state of Virginia within the last five years and no out of state background checks were completed.

Plan of Correction: The request for out of state background checks will be processed by 11/3/22 and the results will be forwarded to the licensing inspector. In the future, when applicable, out of state background checks will be completed within the required time frames.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review and interview, the center failed to have staff sign a sworn disclosure statement prior to the first day of employment and have a completed central registry record check by the end of the 30th day of employment for the four staff records reviewed.

Evidence:

1. The record for staff 1, hire date 8/9/21, has a sworn statement dated 2/15/22.
2. The record for staff 2, hire date 7/1/22, has a sworn statement date 10/25/22 and a central registry background check dated 9/22/22.
3. The record for staff 3, hire date 8/8/22, has a sworn statement dated 10/25/22.
4. The record for staff 4, hire date 7/8/22, has a sworn statement dated 10/25/22 and a central registry background check dated 9/2/22.

Plan of Correction: In the future staff will be required to provide a sworn statement prior to the first date of employment. A central registry background check will be completed and mailed within the first seven days of employment and followed up if the results are not received within 30 days. The staff record will be documents.
