Comments:

An unannounced code compliance inspection was initiated on 12/5/2022 and concluded on 12/5/2022 from 10:27 AM to 12:05 PM. There were 43 children present, ranging in ages from two to five, with 6 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of three children?s records and two staff?s records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard #:	22.1-289.031-A-4
Description:	Based on record review and interview, the center failed to ensure all staff have been certified by a practicing physician or physician assistant to be free from any disability which would prevent him/her from caring for children under his/her supervision prior to start date. Evidence: 1. The record for staff 1 was reviewed. The start date was documented as 2/20/20. There was no staff health report is staff health report in the staff record. 2. The director verified there is no staff health report.
Plan of Correction:	A staff health report will be obtained for staff 2 as soon as one can be scheduled. In the future staff will not be allowed to start working with children until a staff health report is obtained.

Description:	Based on record review and interview, the center failed to establish and implement a procedure to ensure that all staff are able to recognize the signs of child abuse and neglect. Evidence: 1. The record for staff 1 documents the start date as 9/1/22. The documentation of completing training in recognizing child abuse and neglect is 11/30/22. 2. The director verified the date or training.
Plan of Correction:	Staff will be required to completed training in recognizing child abuse and neglect prior to working with children in the future.
Standard #:	22.1-289.035-B-4
Description:	Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment and a criminal history name check prior to the first day of employment for any state in which a staff member resided in the preceding five years. Evidence: 1. The record for staff 1 documents the start date as 9/1/22. The sworn disclosure statement dated 9/1/22 documents staff 1 lived in Texas within the last five years. 2. The record for staff 1 does not contain documentation that a central registry background check or criminal history check was requested or completed for Texas. 3. The director verified neither document was requested.
Plan of Correction:	A central registry check and criminal history check will be sent to Texas for staff 1. Documentation will be forwarded to the licensing inspection showing this has been completed. The results will be forwarded to the licensing inspector. In the future new staff that have resided outside of Virginia five years prior to starting will have background checks completed as required.
