Technical Assistance:
The interstate child care background check contact list was provided to the center to assist in completing out of state background checks.

Comments:
An unannounced code compliance inspection was initiated on 12/12/2022 and concluded on 12/12/2022 from 10:00 AM to 11:00 AM. There were 17 children present, ranging in ages from three to five, with four teacher and one administration. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and procedure. A total of two children?s records and three staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Violations:
Standard #: 22.1-289.031-B-5
Description: Based on interview, the center failed to implement the center's procedure to ensure the center is free of obvious injury hazards.

Evidence:

1. In the 3's and 4's classroom, beside the child height sink in the classroom, was a container of Clorox wipes an Lysol disinfect spray. Both cleaners were accessible to children.
2. The director stated the centers procedure regarding hazardous substances is: Hazardous substances are to be kept in a cabinet above the sink in classrooms out of reach of children or in the locked custodial closet.

Plan of Correction: The hazardous substances were moved to the cabinet above the sink. All staff will be retrained on the centers procedures.

Standard #: 22.1-289.035-B-4
Description: Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment and a search of sex offender registry prior to the first day of employment.

Evidence:

1. The record of staff 2 was reviewed. The employment date was documented as 6/24/22. The sworn statement documents staff 2 resided in TN within five years prior to signing the document on 7/31/22. There were no out of state background checks in the record.
2. The director verified TN background checks were not completed for staff 2.

Plan of Correction: The out of state background check paperwork for staff 2 will be completed as soon as possible. Proof that the paperwork was completed will be forwarded to the licensing inspector and the results will be forwarded to the licensing inspector. In the future the requirements for out of state background checks will be followed.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review and interview, the center failed to have staff sign a sworn disclosure statement prior to the first day of employment and have a completed central registry record check by the end of the 30th day of employment.

Evidence:

1. The record for staff 1 was reviewed. The employment date was documented as 6/24/22. The sworn statement is dated 7/21/22. There is no central registry background check in the record.
2. The record for staff 2 was reviewed. The employment date was documented as 6/24/22. The sworn statement is dated 7/31/22. There is no central registry background check in the record.
3. The record for staff 3 was reviewed. The employment date was documented as 5/5/22. The sworn statement is dated 5/22/22. There is no central registry background check in the record.
4. The director verified the dates and stated the center had not completed central registry background checks for the three staff.

Plan of Correction: In the future new staff will be required to complete a sworn statement prior to employment. Staff 1, 2 and 3 will be required to complete the paperwork for the central registry as soon as possible. Proof that the paperwork was completed will be sent to the licensing inspector and the results will be forwarded to the licensing inspector. In the future central registry paperwork will be processed upon employment for new employees.
