Comments:
A code compliance inspection was initiated on 1-31-2023 and concluded on 1-31-2023. There were 18 children present, ranging in ages from 3 to 4, with 4 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, and medication. A total of 9 staff records were reviewed.

Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based on record review and interview with staff, the center did not ensure each person in a supervisory position must be certified by a practicing physician or physician assistant to be free from any disability that would prevent them from caring for children under their supervision.

Evidence: Staff #8 confirmed Staff #1 and Staff #2 did not have the required health documentation.

Plan of Correction: Staff member #1 and staff member #2 will complete the required staff health form.

Standard #: 22.1-289.031-B-3
Description: Based on inspection and interview with staff, the center has not established and implemented procedures for a daily simple health screening and exclusion of sick children by a trained person.

Evidence: Staff #8 confirmed that there was not a trained person on site to conduct a daily simple health screening.

Plan of Correction: Staff member #7 and staff member #8 will attend a training class on DHO.

Standard #: 22.1-289.035-A
Description: Based on record review and interview with staff, the center did not ensure all applicants for employment, employees, applicants to serve as volunteers, and volunteers shall undergo a background check prior to employment or beginning to serve as a volunteer and every five years thereafter.

Evidence: Staff #1 had an outdated Sworn Disclosure (dated 6-6-2016) and an outdated Central Registry (CPS) (dated 7-8-2016). Staff #8 confirmed information.

Plan of Correction: Staff member #1 will update sworn disclosure and a new central registry will be completed.

Standard #: 22.1-289.035-B-2
Description: Based on record review and interview with staff, the center did not ensure to obtain a fingerprint based national criminal record check prior to the first day of employment for each staff.

Evidence: Staff #8 confirmed that the record for staff #4 (start date 8-23-2022) did not contain documentation of fingerprint check prior to start date.

Plan of Correction: Staff member #4 will obtain a fingerprint background check.
