Comments:
The licensing inspector conducted an unannounced complaint investigation in response to a complaint that was received by the Office of Child Care Health and Safety on February 8, 2023, regarding allegations in the area of safe sleep. The investigation was initiated on February 22, 2023 and concluded on February 22, 2023. On February 22, 2023, the inspector was on site at the center from approximately 1:00pm to 2:05pm. An interview with the center representative and two staff members were completed, observations were made in the center, and documentation was reviewed. Additional documentation was reviewed on March 7, 2023 and the inspection report was revised on March 13, 2023.

The preponderance of the evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1)
steps to correct the noncompliance with the standard(s), 2) measures to prevent noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names, list staff by positions only.

Complaint related: Yes
Description: Based on observation and interviews, the child day center was not in compliance with safe sleep guidelines recommended by the American Academy of Pediatrics.

Evidence:

1. The inspector observed Child #1 (Infant) sleeping in a mechanical swing with a blanket wrapped around the infant.
2. The center representative, staff #1 and staff #2 stated that child #1 only sleeps in a
mechanical swing or a staff member?s arms
3. Staff #1 and staff # 2 both confirmed that child #1 sleeps in a mechanical swing with a blanket during most naps.
4. The American Academy of Pediatrics state that sleep should be avoided in a ?seating device, like a swing? and ?keep loose blankets, pillows, stuffed toys, bumpers, and other soft items out of the sleep space.?

Plan of Correction: All swings have been removed from our infant classroom and are no longer being used. The only form of blankets to be used in our infant classroom will be sleep sacks while the infant is in the crib. All employees have read and are familiar with the safe sleep standards according to Virginia Department of Health Safe Sleep Virginia and the American Academy of Pediatrics.
