Comments:
The licensing inspector conducted an unannounced complaint investigation in response to a complaint that was received by the Office of Child Care Health and Safety on February 16, 2023. The complaint was regarding allegations in the areas of ratio, obvious hazards, and supervision. The licensing inspector was on site March 16, 2023, from approximately 7:45am to 10:45am. Interviews with staff members were completed, observations were made in the center, and documentation was reviewed.

The preponderance of the evidence gathered during the investigation supports portions the allegation; therefore, the complaint is determined to be valid. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names, list staff by positions only.

Description: Based on observations, documentation review and interviews, the center did not ensure that all areas of the premises accessible to children were free of obvious injury hazards, including providing and maintaining sand or other cushioning material under playground equipment.

1. Witness #1 stated a child under the age of two years was observed on the top platform of the wooden playground structure located on the Toddler/Two Playground in February 2023.
2. During the March 16, 2023 inspection, four staff members stated the Toddlers and Twos classrooms use the playground equipment with signage stating, ?THIS PLAYSET IS INTENDED FOR CHILREN AGES 3 TO 10?.
3. The licensing inspector observed the top platform of the playground structure was approximately six feet in height.
4. The end of three slide chutes were observed resting on the bare ground, without sand or other cushioning material.
5. On March 16, 2023, the licensing inspector observed the Older Infants and Toddlers playing in the Ball Room. A 7-Foot tall, enclosed trampoline was in the Ball Room. The manufacture tag stated recommend for children ages 3-10 years. Staff members stated the Toddler children use the trampoline when the Infants are not in the Ball Room.

Description: Based on observations, interviews and documentation review, the center did not maintain the required staff to child ratio of one staff member for 10 children present from ages 36 months to five years. When a group of children receiving care includes children from different age brackets, the age of the youngest child in the group shall be used to determine the staff-to-children ratio that applies to that group.
Evidence:
During the March 16, 2023, inspection the following was observed:
1. From approximately 7:45am to 8:00am, the licensing inspector observed 19 children present in the Pre-K classroom with one staff member, Staff #1.
2. Staff #1 stated she had five Pre-K children (ages four to five years) and 14 school age children in the classroom. Staff #1 states another staff member was due to arrive soon.
3. The daily attendance record indicated 19 children were in the classroom.
4. The age of the youngest child in the group is required to be used to determine the staff-to-children ratio that applied to the group.
