Comments:
A code compliance inspection was initiated and concluded on 4/18/2023. There were 22 children present, ranging in ages from 3 to 4, with 5 staff supervising. The inspector reviewed compliance in background checks and requirements for child day centers operated by religious institution exempt from licensure. A total of 5 staff records were reviewed.

Information gathered during the inspection determined non-compliance(s) with applicable code sections and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.031-A-4
Description: Based on record review and interview with staff, the center did not ensure each person in a supervisory position must be certified by a practicing physician or physician assistant to be free from any disability that would prevent them from caring for children under their supervision.

Evidence: The Director confirmed that there was no documentation that Staff #2, and #3, who are in supervisory positions, had been certified by a practicing physician or physician assistant to be free from any disability that would prevent them from caring for children under their supervision.

Plan of Correction: Staff #2 and staff #3 have submitted their forms to their physicians to be filled out.

Standard #: 22.1-289.031-A-6
Description: Based on document review and staff interview, the center had not described all required aspects of the child day center's operations in a written statement to the parents or guardians of the children in the center and made available to the general public.
Evidence: The Director confirmed that the physical facilities and public liability insurance had not been provided in writing to the parents/guardians and made available to the general public.

Plan of Correction: Updated information on physical facilities used and public liability insurance will be added to the handbook. An addendum to the current handbook will be sent home.

Standard #: 22.1-289.035-B-2
Description: Based on record review and interview with staff, the center did not ensure to obtain a fingerprint based national criminal record check prior to the first day of employment for each staff.
Evidence: The Director confirmed that the record for staff #1, 3, 4, and 5 did not contain documentation of a fingerprint check prior to the first day of employment.

Plan of Correction: Staff #1, 3, 4 and 5 have all began the process of completing a fingerprint check.

Standard #: 8VAC20-770-40-D-2
Description: Based on record review and staff interview, the center did not ensure that a prospective employee, volunteer, or any other person who is expected to be alone with one or more children enrolled in the religious exempt child day center shall undergo a search of central registry (within 30 days of employment or commencement of service) and have a sworn statement of affirmation (before employment or commencement of service at the facility).
Evidence: Staff #1, 2, 3, 4, and 5 did not have documentation of a search of the central registry or a sworn statement of affirmation.

Plan of Correction: All currently employed staff have signed and dated a sworn statement of affirmation.
