Comments:
A Subsidy Health and Safety Inspection was conducted on Wednesday, April 5, 2023. The inspector was on site from 11:00am to approximately 2:20pm. There were 65 children in attendance with 12 staff directly supervising. During the inspection, the children and staff were observed participating in a variety of activities. Staff were observed having positive interactions with the children. All areas of the facility including classrooms, hallways, the outdoor play area, and bathrooms were inspected. Six children's records and six staff records were reviewed.

A licensing inspection was also conducted on this date. Both inspections combined cover subsidy health and safety regulations. Only subsidy requirements that are not covered in licensing standards were reviewed during this supplemental inspection. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Violations:
Standard #: 22.1-289.035-B-2
Description: Based on a review of six staff records and interview, the vendor did not ensure four staff had the satisfactory results of the fingerprint-based national criminal background check prior to employment.

Evidence: 1) The fingerprint-based national criminal background check in the record of Staff #1, employed on 08/29/22, was dated 09/13/22.

2) The fingerprint-based national criminal background check in the record of Staff #2, employed on 01/24/23, was dated 02/24/23.

3) The fingerprint-based national criminal background check in the record of Staff #5, employed on 09/09/22, was dated 09/21/22.

4) The fingerprint-based national criminal background check in the record of Staff #6, employed on 02/21/23, was dated 03/07/23.

5) During interview, a member of management confirmed the fingerprint results for Staff #1, Staff #2, Staff #5, and Staff #6 were not received prior to employment.

Plan of Correction: All fingerprints have been obtained. In the future, fingerprint results will be required prior to employment.

Standard #: 22.1-289.035-B-4
Description: Based on a review of six staff records and interview, the vendor did not obtain the results of a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from any state in which one staff member had resided in the preceding five years within the required timeframe.

Evidence: 1) The record of Staff #4, employed on 11/28/22, indicated the staff had resided in another state outside of Virginia within the last five years. The record did not contain a sex offender registry check or a search of the child abuse and neglect registry from that state. The out-of-state sex offender registry check is required to be obtained prior to employment and the out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of employment.

2) During interview, a member of management confirmed the required out-of-state checks were not obtained for Staff #4 within the required timeframe.

Plan of Correction: The missing out-of-state background checks will be requested.

Standard #: 8VAC20-790-560-A
Description: Based on a review of six staff records, the vendor did not ensure four staff members had documentation of a negative tuberculosis (TB) screening within the required timeframe.

Evidence: 1) The TB screening in the record of Staff #1, employed on 08/29/22, was completed on 09/12/22.

2) The TB screening in the record of Staff #3, employed on 12/07/22, was completed on 02/03/23.

3) The TB screening in the record of Staff #5, employed on 09/09/22, was completed on 09/11/22.

4) The most recent TB screening in the record of Staff #6, employed on 02/21/23, was completed on 03/20/23. A previous TB screening in the record was completed on 09/04/22.

Documentation of the screening shall be submitted at the time of employment and prior to coming into contact with children. The documentation shall have been completed within the last 30 calendar days of the date of employment and be signed by a physician, physician's designee, or an official of the local health department.

Plan of Correction: In the future, TB results will be required prior to employment and will be dated no more than 30 days prior to employment.
