8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Comments:
An investigation was initiated on 5/11/23 in response to a self-reported incident received by the department regarding a child being left on a playground on 5/10/23. An on-site joint investigation with the local agency was conducted on 5/23/23 and interviews with staff and other individuals on 5/23/23 and 6/2/23. Documentation and records related to the incident were also reviewed. Interviews with staff and other individuals were conducted on 5/23/23 and 6/2/23. Based on the information gathered during the investigation the self-reported incident regarding a child being left on the playground was determined to be valid. Violations not related to the self-report were also found during the inspection. Violations are cited on the violation notice provided to the center and were discussed with the center director at the conclusion of the investigation.

Standard #: 8VAC20-790-540-B-12
Description: Based on review of children's records, it was determined that the vendor did not ensure that all required information was included in the child's record.
Evidence: The record for Child #2, date of enrollment 1/24/22, did not include proof of identity and age as required by 22.1-289.049 of the Code of Virginia.

Plan of Correction: Vendor received proof of identity and age from the parent on 5/24/2023.

Standard #: 8VAC20-790-600-D-1
Description: Based on review of staff records, it was determined that the vendor did not ensure that all staff had current cardiopulmonary resuscitation (CPR) within 90 days of employment.
Evidence:
1 A. Staff #2 was working on 5/10/23.
B. Staff #2 had a hire date of 11/28/22 and did not have documentation of current CPR within 90 days of employment.

Description: Based on review of staff records, it was determined that the vendor did not ensure that all staff had current first aid certification within 90 days of employment.
Evidence:
1 A. Staff #2 was working on 5/10/23.
B. Staff #2 had a hire date of 11/28/22 and did not have documentation of current first aid certification within 90 days of employment.

Standard #: 8VAC20-790-670-H
Description: Based on interviews, written statements and documentation the vendor failed to ensure that children under 10 years of age shall always be within actual sight and sound supervision of staff.
Evidence:
Upon leaving the playground and returning to the classroom Child #1, (2 years of age) was left alone on the playground.
1. The vendor self reported to the department that Child #1 (2 years of age) was left alone and unsupervised on the playground for 5-8 minutes.
2. Individuals #1 and #2, unknown to Child #1, confirmed in written statements that they saw Child #1 alone on the playground and in the playhouse. Individual #1 alerted Staff #4 that the child was alone on the playground and Staff #4 brought Child #1 inside.
3. Staff members #1, #2, #3, #4 confirmed that the child was left alone on the playground.

Plan of Correction: All staff have been retrained in the playground policy and supervision requirements including, counting of children and face to face roll check before leaving to go outside, coming back in, and throughout the day.
