8VAC20-790 Subsidy Program Vendor Requirements for Child Day Centers

Comments:
An initial subsidy health and safety inspection (SHSI) was conducted on 10/13/2023 from 9:45am-10:45am At the time of the inspection, there were 38 children present with nine staff supervising. Children were observed participating in morning movement activities, circle time and eating snack. Evacuation drills,12 staff records, three children's records and other center documents were also reviewed.
Information gathered during the inspection determined non-compliance(s) with applicable standards or law, and violations were documented on the violation notice issued to the program and discussed with the Director during the exit interview.

Violations:
Standard #: 22.1-289.035-B-4
Description: Based on a review of 12 staff records, it was determined that the vendor did not ensure that all staff who had lived out of state within the past five years had a criminal record check and a central registry check on file.
Evidence:
Staff #8 indicated on her sworn statement that she had lived out of state in the past five years. The state is considered a "NFF" state, so criminal history checks were not required. However, there was no central registry check for the state in which the staff member had lived.

Plan of Correction: Facility will request appropriate background checks and when results are received, they will be placed in staff member's records.
